المستخلص: اهتمت الدول على اختلاف أنظمتها القانونية بتجريم الكسب غير المشروع، ويعد العقاب هو الجزاء الذي يقره القانون لمكافحة الجريمة. وتتجلى أهمية الدراسة في أن الدولة العراقية بمؤسساتها الدستورية يواجهان في هذه المرحلة هجمة شرسة من أصحاب النفوس الضعيفة، أدت إلى ازدياد الجرائم المتعلقة بالوظيفة العامة والمال العام. وتهدف الدراسة للوصول إلى نظام قانوني متكامل قادر على مواجهة جريمة الكسب غير المشروع بإيجاد نظام قانوني متكامل قادر على مواجهتها والحد منها، عبر تعزيز الفاعلية للقواعد الجزائية، يكون ضروريا لتقليص فرص الفساد. إن إشكالية دراستنا تبرز في أن عملية تفعيل دور القانون الجنائي لا تكفي بحد ذاتها وإنما تستند إلى غيرها، ومن ثم فأنها لا تعتمد على سياسة التجريم والعقاب فقط، وإنما الأمر يتطلب إصلاحات في الجوانب الأخرى التي تتلخص في كيفية تحقيق التكامل بين كل هذه الجوانب ذات الطبيعة المختلفة وصولاً لتحقيق الغاية في تعزيز وتفعيل دور القانون الجنائي في مواجهة جريمة الكسب غير المشروع. وقد توصلنا في ختام هذه الدراسة إلى مجموعة من النتائج والتوصيات نورد أهمها في التالي: -إن تجريم الكسب غير مشروع هدفه غلق كافة السبل التي تؤدي إلى الإضرار بالمال العام وتحقيق مكاسب شخصية للموظف العام من خلال الوظيفة العامة التي يشغلها. إن المصلحة محل الحماية الجنائية بتجريم الكسب غير المشروع تتمثل بالوظيفة العامة والمال العام. ومن اهم التوصيات: ضرورة أن يكون تعريف جريمة الكسب غير المشروع يشمل كل ما يحصل علية الموظف أو المكلف بخدمة عامة سواء أكان مال أو غيره، كالخدمات والمنافع الشخصية التي يحصل عليها. وأن يقرر القانون مكافأة مالية مجزية لكل شخص يخبر عن جريمة الكسب غير المشروع وكان إخباره قد ساعد في كشف الجريمة وتوفير الأدلة ضدها.

States have been concerned about the difference in their legal systems by criminalizing graft, and punishment is the sanction established by law to combat crime. The importance of the study is that the Iraqi state and its constitutional institutions are facing at this stage a fierce attack by the owners of vulnerable people, led to an increase in crimes related to public service and public money. The aim of the study is to reach an integrated legal system capable of confronting the crime of graft by creating an integrated legal system capable of confronting and reducing it through enhancing the effectiveness of penal rules, which is necessary to reduce the chances of corruption. The question is that the process of activating the role of the criminal law is not sufficient in itself, but is based on others. Therefore, it does not depend on the policy of criminalization and punishment only, but it requires reforms in other aspects, which is how to achieve integration between all these aspects of different nature with the aim of strengthening and activating the role of criminal law in the face of the crime of graft. At the conclusion of this study, we reached a set of conclusions and recommendations, the most important of which are the following: The criminalization of illegal gain is the goal of closing all avenues that lead to harming public money and achieving personal gains for the public employee through the public service he occupies. Interest in the place of criminal protection by criminalizing illicit gain is public and public money. Recommendations: We believe that the definition of the crime of graft should include all that the employee or public service officer receives; whether money or other, such as the services and personal benefits that he receives. We believe that the law should establish a rewarding financial reward for every person who reports the crime of graft and was informed of the crime and helped to uncover the crime and provide evidence against it.
