المستخلص: Introduction: The modern world is witnessing a great and rapid development in communication technology, especially the Internet. The information industry has emerged, and the operational and application programs. The reliance on computers, information systems, and operational and practical programs has become a reality, which requires the provision of legal protection to maintain the efforts of the owners The problem of the study: The owner of the scientific development in the field of intellectual production The emergence of a range of innovative works, namely computer programs, resulting in infringement of the rights of their owners, and the emergence of cybercrime, which requires the need to confront these information crimes by highlighting the legal rules that include the punishment of violators, And protect copyright from any threat. Study Methodology: The selected approach, which is part of this study, is the descriptive and analytical approach, through reading the texts and analyzing them to identify the problem that this study addresses. Objectives of the study: Clarification of the protection of intellectual property rights after the emergence of infringement of intellectual property rights, identify the legal means to provide the necessary protection for computer software and to explain the standard of works on which the work subject to the protection of the law is determined. The most important results: The intellectual property laws are insufficient to protect the authors of the programs, the current legal rules do not apply to reality as prepared for them, and therefore found electronic crimes and infringement of copyrights (theft, exploitation, imitation, copying, virus cultivation, information misrepresentation) The reluctance of domestic and foreign capital to invest in software because they feel that the environment is not protected for their products.

المقدمة: يشهد عالمنا المعاصر تطورا كبيرا ومتسارعا في تكنولوجيا الاتصالات وعلى رأسها شبكة الإنترنت، فظهرت صناعة المعلومات، والبرامج التشغيلية والتطبيقية. فأصبح الاعتماد على الحاسب الآلي، ونظم المعلومات، والبرامج التشغيلية والتطبيقية واقع لا بد منه، الأمر الذي تطلب توفير الحماية القانونية للحفاظ على الجهود المبذولة من أصحابها مشكلة الدراسة: صاحب التطور العلمي في مجال الإنتاج الفكري ظهور طائفة من المصنفات المبتكرة وهي برامج الحاسب الآلي، نتج عن ذلك تعدي على حقوق اصحابها، فبرزت الجرائم المعلوماتية وهو ما تطلب ضرورة مواجهة تلك الجرائم المعلوماتية وذلك من خلال إبراز القواعد القانونية التي تتضمن معاقبة المخالفين، وحماية حقوق المؤلف من أي تهديد. منهج الدراسة: المنهج المختار الذي تندرج هذه الدراسة في إطاره هو المنهج الوصفي والتحليلي، من خلال قراءة النصوص وتحليلها للتعرف على المشكلة التي تتناولها هذه الدراسة. أهداف الدراسة: توضيح حماية حقوق الملكية الفكرية وذلك بعد ظهور جرائم التعدي على حقوق الملكية الفكرية، التعرف على الوسائل القانونية الي توفر الحماية اللازمة لبرمجيات الحاسوب الآلي وشرح معيار المصنفات التي يتحدد على أساسه العمل الذي يخضع لحماية القانون أهم النتائج: قوانين الحقوق الفكرية غير كافية لحماية مؤلفي البرامج، والقواعد القانونية الحالية لا تطبق على الواقع كما أعد لها، وبالتالي وجدت الجرائم الإلكترونية والتعدي على حقوق التأليف من (سرقة أو استغلال أو وتقليد ونسخ، وزراعة الفيروسات، وتحريف المعلومات)، نتج عن ذلك عزوف رأس المال المحلي والأجنبي عن الاستثمار في مجال البرمجيات لشعورهم بأن البيئة غير محمية لمنتجاتهم.
