|d La participation de l'actionnaire à la société par actions lui confère des droits et des obligations qui constituent une position juridique au sein de la société qui le distingue du reste des positions juridiques qui y sont situés.\nCependant, la réalité a montré que l’actionnaire avait abandonné bon nombre de ces droits et obligations et sa recherche du profit, ce qui avait contribué à creuser le fossé qui les séparait de la société.\nIl est donc nécessaire de trouver des solutions qui réduisent cet écart, rapprochent l’actionnaire et la société, renforcent leurs relations et leur permettent de se soustraire au statut que lui reconnaît la loi.
