المستخلص: يختص هذا البحث الموسوم بـ "شبهة تعطيل النص عند الخلفاء الراشدين، اجتهادات عمر بن الخطاب (رضي الله عنه) أنموذجاً "بمعالجة مشاكل أصولية وفقهية وفكرية واجهت نصوص الشريعة الإسلامية المباركة، وذلك بإثارة شبهات تجوز بإثباتها تعطيلها في بعض الأحيان والحالات لأجل المصلحة وتغير الواقع الاجتماعي أو السياسي. واستدل أصحاب تلك الشبه بما يفهم من ظاهر بعض اجتهادات الخلفاء الراشدين الذين يعتبرون من أجل أصحاب رسول الله (صلى الله عليه وسلم) بالتمسك بسنتهم واجتهاداتهم، وخصوصاً اجتهادات الخليفة الثاني عمر بن الخطاب (رضي الله عنه). فحاول البحث أن يرد على تلك الشبهات معتمداً على المصادر الرصينة للشريعة، والرجوع إلى واقع تلك الاجتهادات من خلال المصادر الحديثية، وأثبت أن تلك الاجتهادات لم تكن في معرض النص، ولم يعطل بها تلك النصوص. وهدف البحث الذب عن نصوص الشرعية المباركة بالتعطيل، والتأويل الفاسد، والتفسير الدقيق والصحيح لما قد يوهم من فقه واجتهادات خلفاء الرشدين أنها عطلت بها النصوص.

Suspicion to disable the texts of sharia by the caliphs, especially the diligences of Umar bin Al Katattab – May Allah pleased to him. This research tried to solve a scientific problem which is removing some suspicion stimulated by some writers and researchers of the Islamic world in the end of the past century and this century, regarding the texts of sharia that are the Quran and Sunna they adopted it on many diligences of the caliphs of the prophet (peace be upon him) especially the diligences of Umar Ibn Al Katattab which is seemingly read as he disabled the texts of sharia according to their point of view and their interests. The research is composed of an introduction, two main types, conclusion, and suggestion: in the introduction, explained the importance of the subject and the reasons to write this subject and mentioned the previous researches. In the first part, defined the concepts of the subject and described the importance of diligences of the previous caliphs and shed lit on some suspicions told. In the second part, responded the suspicions by depending upon the scientific sources of the subject. In the conclusions, described the conclusions that the researcher achieved and suggested new things for the competent authorities.
