المستخلص: تعتبر مسؤولية الوزير الأول، مسؤولية مضاعفة أمام كل من رئيس الجمهورية وكذا أمام البرلمان ، وذلك نظرا لخضوع هذا الأخير إلى رئيس الجمهورية في تعيينه وكذا في إنهاء مهامه مما يجعله تحت رحمة الأول، هذا من جهة ومن جهة أخرى ، فان التعديل الدستوري لسنة 2016 ، جاء بتجريد للوزير الأول من برنامجه السياسي ، فأصبح بذلك مجرد مساعد لرئيس الجمهورية ، ومع ذلك أبقي على مسؤوليته كاملة، ففيما يتعلق بقيام مسؤولية هذا الأخير أمام رئيس الجمهورية، فيتجلى ذلك من خلال السلطة المطلقة لرئيس الجمهورية في تعيينه وكذا في عزله، وهذا بنص الدستور وما يعزز ذلك الطبيعة المتدهورة جدا لمركز الوزير الأول مقارنة برئيس الجمهورية، بل وتعززت هذه المسؤولية أمام هذا الأخير الذي قد يصبح في ظل التعديل الدستوري لسنة 2016، الرئيس الحقيقي والوحيد للسلطة التنفيذية، في حالة توافق الأغلبيتين البرلمانية والرئاسية، كما هو عليه الحال في الوقت الراهن، غير أن تغيير عبارة مخطط عمل لتنفيذ برنامج رئيس الجمهورية بعبارة مخطط عمل الحكومة يمكن أن تفضي إلى عودة ثنائية السلطة التنفيذية وعقلنة مسؤولية الوزير الأول، كما أبقى على المسؤولية السياسية للوزير الأول أمام البرلمان متمثلا ذلك في الرقابتين السابقة و اللاحقة لمباشرة الحكومة لمهامها وكدا ترك الأدوات التقليدية للرقابة البعدية من سؤال واستجواب وتحقيق، وهو ما يجعل الوزير الأول في وضع غريب وضعيف قل نظيره في الأنظمة الدستورية الديمقراطية، يناقض تماما القاعدة الدستورية القاضية بأنه، حيثما توجد سلطة، توجد مسؤولية، أما وقد جرد هذا الأخير مما تبقى له من سلطات، (برنامجه السياسي. و بناء على ما تقدم ما الجدوى من إبقاء هذه المسؤولية المضاعفة عليه ؟. إن هذا الوضع لا يستقيم إلا باختيار أحد النظامين النيابيين البرلماني أو الرئاسي وبوضوح

There is a famous saying in the constitutional Jurisprudence says that : "where ever there is an authority, there is a responsibility, and by analyzing the Algerian constitutional system especially about the responsibility of the prime minister, so in which extent has this saying been realized in the light of the latest constitutional amendment in 2016? I will try to answer the following question; What is the nature of the responsibility and by which the real position of the prime minister in the Algerian constitutional system in the light of the amendment of 2016? According to the Algerian constitutional amendment of 2016, the prime minister has no effective authorities, especially after replacing his programme by the president of the republic s one, which clarify the nature of the practiced programme that was namely belong to the prime minister, but in fact, it was the president s. Now, in the light of the constitutional amendment of 2016,by replacing the president s programme by the government plan of work, its possible to rationalize the prime minister responsibility the prime minister has loosed even his unique pure authority, they are all in the president s programme service all this make the prime minister just an assistant for the president of the republic who is not responsible politically but has a huge authorities, whereas the prime minister has no effective authorities which leads to put the later in a very weak position comparing with the president of the republic and this means that there is no real double executive authority rather then a unique one presided by the president of the republic which means that there is a change in the nature of the Algerian constitutional system from the semi parliament system to the closed presidential one. This means that the constitutional system should be clarified either a parliament or a clear presidential one.
