المستخلص: تناول البحث دليل الاستحسان من الناحية المقاصدية، ومن ثم عنونت له ب (الاستحسان ودوره في تحقيق مقاصد الشرع). وعالجته في ثلاثة أقسام رئيسة: ففي الأول: ذكرت تعريف الاستحسان والمقاصد، وبينت العلاقة بينهما من حيث المفهوم. وفي الثاني: ذكرت قسمي الاستحسان وفي الثالث: تكلمت عن علاقة الاستحسان بالمقاصد من حيث أنواعه. وكان الهدف منه: بيان مدى ارتباط الاستحسان بالرؤى المقاصدية وتحقيقه لها، وذلك من خلال العرض للتعريف والأنواع وإيراد النماذج والتطبيقات، التي تجلي المعاني الشريعة، ونستبين منها الصلة الوثيقة بين علم الأصول وعلم المقاصد وعلم الفروع. وقد ثبت أنه لا منافاة بين ما يهدف إليه الاستحسان وبين ما تقتضيه مقاصد الشرع؛ فإن جميع أنواع الاستحسان تحقق غالباً مقصد التيسير ورفع الحرج عن المكلفين، وهو من المقاصد العامة المقطوع بها، ولا غرو في ذلك؛ إذ العمل بالاستحسان يعود إلى مقصد اعتبار المآلات، الذي يعني برفع الحرج عن المكلفين، ويهدي إلى المنهج القويم الذي يجب أن يُسك في فهم الأدلة وتطبيق النصوص، فلابد من ربط الفهم بالمآلات، وتقييد عقد الأفعال والتصرفات بالآثار. فالاستحسان متفرع عن النظر في المآلات، محقق لمقصد التيسير ورفع الحرج. والله ولي التوفيق.

The research addresses the evidence of Istihsaan from the aspect of the Islamic aims. Thus, I entitled it “Al-Istihsaan and Its Place in Fulfilling the Legislated Aims.” I divided the research into three main divisions: In the first, I mentioned the definition of Istihsaan and the Islamic aims. I clarified the relationship between the two in regards to their understanding. In the second, I mentioned the two divisions of Istihsaan. Finally, in the third, I addressed the relationship of Istihsaan and the Islamic aims in regards to their types. The purpose of it was to clarify the extent of Istihsaan connections to the perspective of the Islamic aims and the fulfillment of it. That is by way of presenting its definition and types, and showing the method of application. All in which elucidate the Islamic legislated meanings. We will seek to make clear the correlation between the science of usul-ul-fiqh, the science of Islamic aims, and the science pertaining to issues of fiqh rulings. It is affirmed that there is no contradiction between what Istihsaan objects and between that which the aims of the shariah necessitate. Indeed every type of Istihsaan actuates the majority of the aims which promote ease and the removal of hardship from the legally responsible. Istihsaan is from the Islamic general aims that are absolute and that there is in not doubt; being that the appliance of Istihsaan returns to the aim of regarding the prospective. Which is concerned with removing difficulty from the legally responsible and it guides to the correct method which it is obligatory to tread in understanding evidences and applying the text. Therefore the correlation between the understanding and the prospective is necessary; and the restricting of actions and behavior concluding by influence. Thus Istihsaan is extended from the perspective of the aim which treats the prospective and which actualizes disburdening and the removal of hardship. Allah is the withholder of all success.
