Since the dawn of history and war has been necessary for humanity in all ages, there have been wars of grinding measured human woes over the years and centuries. These wars have been - and continue to be - sweeping countries and afflicting peoples, destroying the features of civilizations and national wealth, and increasing its severity generation after generation in view of the massive development of weapons of mass destruction. This led to the existence of an international law that regulates the rules and norms of war, governs relations between warring forces, guarantees the protection of civilians, wounded and prisoners, and alleviates the tragedies caused by wars and armed conflicts. The development and codification of international humanitarian law emerged in the 1860s, whose bases continued to develop - as a result of atrocities committed during wars, to protect humanity and without distinction of any category at the expense of others - under international humanitarian law "He said Facts and experiences of peoples show that the most vulnerable groups in society, such as women and children, are the most vulnerable during any armed conflict, both internal and external. Millions of women worldwide are still subjected to various kinds of violations of their rights In addition to the physical and psychological harm, and this is evident to the observer of the reality of the suffering of Palestinian women under Israeli occupation, except for exploitation, especially sexual exploitation and physical violence during armed conflicts.
منذ فجر التاريخ والحرب حدث لازم البشرية في جميع العصور، فقد حدثت حروب طاحنة قاست ويلاتها البشرية على مر الأعوام والقرون. وكانت هذه الحروب -ولا تزال -تجتاح البلدان وتؤلم الشعوب، وتدمر معالم الحضارات والثروات الوطنية، وتزداد قسوتها جيلاً بعد جيل بالنظر إلى التطور الهائل في أسلحة معدات الدمار. مما دعا إلى وجود قانون دولي ينظم قواعد وأعراف الحرب، ويحكم العلاقات بين القوات المتحاربة، ويضمن حماية المدنيين والجرحى والأسرى، وتخفيف المآسي التي تخلفها الحروب والنزاعات المسلحة. فظهرت حركة تطوير وتقنين القانون الدولي الإنساني في ستينات القرن التاسع عشر والذي استمرت قواعده في التطور -كنتيجة للفظائع التي ترتكب أثناء الحروب، ولحماية الإنسانية ودون تمييز أي فئة من الفئات على حساب غيرها -تحت ما يسمى القانون الدولي الإنساني". تثبت الوقائع وتجارب الشعوب أن الفئات الأضعف في المجتمع كالنساء والأطفال هم الأكثر عرضة للانتهاك أثناء أي نزاع مسلح سواء داخلي أو خارجي، فتمثل النساء ضحية سهلة مباشرة ومستهدفة للانتهاكات الجسيمة أثناء النزاعات المسلحة عدا عن أنها تتحمل كافة الآثار الكارثية الناتجة عن تلك النزاعات. نتيجة لذلك حظيت المشكلات التي واجهتها النساء في حالات النزاعات المسلحة باهتمام متزايد فقد شهد القرن العشرين نقلة نوعية في مجال حماية المرأة أثناء النزاعات المسلحة وتقوية مكانتها في المجتمع وتعزيز دورها في تحقيق السلم والأمن الدوليين. وعلى الرغم أن الإنسانية قد خطت خطوات هائلة لصالح النساء، وحققت الكثير من الإنجازات في مجالات عديدة تخص النساء، إلا أن وضع النساء في النزاعات المسلحة يظل خطيرا ولا يمكن السكوت عنه، فهناك ملايين النساء على مستوى العالم لا زلن يتعرضن لشتى أنواع الانتهاكات لحقوقهن بالإضافة للأذى الجسدي والنفسي وهذا يظهر جليا للمتتبع لواقع معاناة المرأة الفلسطينية الواقعة تحت الاحتلال الإسرائيلي، عدا عن الاستغلال وخاصة الاستغلال الجنسي والعنف الجسدي أثناء النزاعات المسلحة.
