In this paper, we presented three topics that dealt with a definition of the term public transactions in terms of legislation, jurisprudence, as well as the legislative standards of public transactions and the general principles that govern them.

إن للصفقات العمومية أهمية كبرى تتضح بالنظر لصلتها الوثيقة بالخزينة العامة للدولة، وما تكلفه من اعتمادات مالية ضخمة تعدد وتنوع الهيئات الإدارية من جهة وتعدد أنواع الصفقات العمومية من جهة أخرى، وقد قدمنا في هذه الورقة البحثية ثلاث محاور عالجت تعريفا لمصطلح الصفقات العمومية من ناحية التشريع واجتهادات القضاء والفقه، والوقوف على المعايير التشريعية للصفقات العمومية، والمبادئ العامة التي تحكمها.
