المستخلص: Access to the truth in criminal cases is one of the most important issues of concern to the criminal judge, who always seeks to have his judgment based on certainty rather than on suspicion and probability. Therefore, the proof of committing the crime must be established. Forensic medical evidence provided by the forensic physician is one of the most important evidence. It contributes to the service of justice by providing clear scientific results, which, when adopted, may reinforce or deny pre-available evidence such as witness testimony, clues and even confessions of the accused himself. It also helps to guide investigations in the proper direction, especially in cases and crimes against physical integrity, specifically the crime of beatings and deliberate wounding committed against the wife, where the forensic physician contributes to the proper legal characterisation of the criminal offence. In the new amendment to the Penal Code by Law 15-19 of 30 December 2015, Algerian legislator has emphasised on the punishment of a husband who physically, even verbally and psychologically, abused his wife to protect women in general and the wife in particular from all forms of violence.

L'accès à la vérité dans les affaires pénales est des questions les plus importantes qui préoccupent le juge pénal qui veut fonder ses jugements sur l'affirmation et la certitude et non sur des conjectures et la possibilité, cet objectif nécessite la mise en place des éléments de preuve de la commission de l’infraction, les éléments de preuve médico-légale fournie par le médecin légiste constituent les preuves les plus importantes, ce qui contribue au service de la justice pour fournir des résultats clairs scientifiques qui, une fois adoptés peuvent améliorer ou réfuter des preuves déjà disponibles comme la déposition des témoins ou d’autre indices, et même des aveux de l'accusé luimême , ils contribuent également à diriger des enquêtes dans le bon sens, en particulier dans les cas des infractions touchant à l’intégrité physique et plus particulièrement l’infraction des coups et des blessures intentionnelles contre la femme, la preuve médico-légale contribue à donner la qualification juridique correcte à l'incident criminel s’il constitue un délit ou un crime. Le législateur algérien a souligné dans le nouvel amendement du Code pénal en vertu de la loi 15-19, en date du 30 Décembre, 2015, dans la punition d'un mari qui agresse son épouse physiquement et même verbalement et psychologiquement, afin de protéger la femme en général et l’épouse en particulier de toutes les formes de violence.

يعتبر الوصول إلى الحقيقة في القضايا الجزائية من أهم المسائل التي تؤرق القاضي الجزائي الذي يسعى دائما لأن يكون حكمه مبنيا على الجزم واليقين لا على الظن والاحتمال، والوصول إلى هذه الغاية يقتضي إقامة الدليل على ارتكاب الجريمة، ويعد الدليل الطبي الشرعي الذي يقدمه الطبيب الشرعي من أهم الأدلة الجنائية، حيث يساهم في خدمة العدالة بتوفير نتائج علمية واضحة والتي عند تبنيها قد تعزز أو تنفي أدلة متوفرة مسبقا كشهادة الشهود أو القرائن وحتى إعترافات المتهم نفسه، كما تساعد على توجيه التحقيقات الوجهة السليمة، خاصة في القضايا والجرائم الماسة بالسلامة الجسدية وبالتحديد جريمة الضرب والجرح العمدي المرتكبة ضد الزوجة حيث يساهم الطبيب الشرعي في إعطاء التكييف القانوني الصحيح للواقعة الإجرامية. ولقد شدد المشرع الجزائري في التعديل الجديد لقانون العقوبات بموجب القانون 15 – 19 المؤرخ في 30 ديسمبر 2015، في عقاب الزوج الذي يقوم بتعنيف زوجته جسديا وحتى لفظيا ونفسيا، وذلك بهدف حماية المرأة عموما والزوجة خصوصا من كل صور العنف.
