المستخلص: Traffic accidents are considered one of the gravest threats to human security and his existence in this era. No country in the world is no longer free of its dangers due to the heavy loss of life and property caused by these accidents. Therefore, these countries, including Algeria, have taken on the task of regulating road traffic and ensuring its safety through the establishment of protective legal mechanisms to monitor the actors involved in the accident, especially drivers, pedestrians, human passengers, vehicles in addition to the road. But even with the presence of these mechanisms, traffic accidents have been and are still posing a danger. Thus, this study is devoted to knowing the adequacy and effectiveness of the legal mechanisms for the prevention of traffic accidents in Algerian legislation. The study is divided into two chapters: the first chapter is devoted to defining the concept of a traffic accident, while the second chapter explains the preventive legal mechanisms to avoid the occurrence of a traffic accident. The study ended with a conclusion that outlined the important findings and suggestions.

Les accidents de la circulation sont l'une des menaces les plus importantes pour la sécurité humaine et son existence dans cet âge, qui ne risque plus aucun pays dans le monde en raison de la perte de la vie et de la propriété. Dans le cadre duquel l'Algérie a pour mission d'organiser le trafic routier et d'assurer sa sécurité grâce à la création de mécanismes juridiques préventifs par lesquels les acteurs, en particulier les conducteurs, les piétons, les passagers en tant qu'êtres humains, les véhicules et les routes sont surveillés. Cependant, malgré l'existence de ces mécanismes, les accidents de la circulation ont été et constituent toujours un danger. Par conséquent, l'étude a examiné la suffisance et l'efficacité des mécanismes juridiques pour la prévention des accidents de la route dans la législation algérienne en les divisant en deux sections, La première montre le concept d'accident de la circulation et la seconde montre les mécanismes de prévention, conclu avec une conclusion qui a montré les résultats et les suggestions les plus importants.

تعتبر حوادث المرور من أهم الأخطار التي باتت تهدد أمن الإنسان، ووجوده، في هذا العصر، والتي لم تعد تخلو من أخطارها أية دولة في العالم، نظرا لما تخلفه من خسائر فادحة في الأرواح، والممتلكات، ولذلك أخذت هذه الدول، بما فيها الجزائر على عاتقها مهمة تنظيم حركة السير عبر الطرقات، وضمان سلامتها عن طريق إيجاد آليات قانونية وقائية تراقب من خلالها العناصر الفاعلة في وقوعه لا سيما السائقين، الراجلين، والركاب كعنصر بشري، والمركبات، إضافة للطريق، لكن وبالرغم من وجود هذه الآليات، فإن حوادث المرور كانت وما زالت تصنع الخطر، ولذلك خصت بهذه الدراسة، للوقوف على مدى كفاية وفاعلية الآليات القانونية للوقاية من حوادث المرور في التشريع الجزائري، من خلال تقسيمها، إلى قسمين خصص الأول لتحديد مفهوم الحادث المروري، والثاني لبيان الآليات القانونية الوقائية لتفادي وقوع الحادث المروري، وختمت بخاتمة بينت أهم النتائج والاقتراحات.
