|f In the Code of Civil and Administrative Procedure, the Algerian legislature has devoted special attention to family matters. It has a full section of the Code of Civil and Administrative Procedure, which explains the judicial procedures followed in settlement of family disputes. It also explains the powers of the judge in cases of divorce, guardianship of minors, descent, foster care and inheritance, to give effect to the judicial protection of the family in general, and the minor or incompetent in particular as the weak party thereof. In addition to that, the legislature has extended the competence of the judge by giving him the right to intervene automatically without the need to issue orders of an urgent nature. It also made the office of the public prosecutor, or anyone concerned to intervene in order to protect the weak, if necessary.\nThis abstract translated by Dar AlMandumah Inc 2018.

|d Le législateur algérien a accordé une attention particulière aux affaires de la famille dans le Code de procédure civile et administrative, Où il a donné une section complète et a expliqué les procédures judiciaires suivies dans le règlement des différends liés à la famille, Et les pouvoirs du juge en cas de divorce et de juridiction sur le mineur et l'ascendance et le parrainage et la succession, afin d'activer la protection judiciaire de la famille en général, Et le mineur en tant que partie faible, Le législateur a également eu l'intention d'élargir le pouvoir du juge en lui permettant d'intervenir automatiquement sans avoir à donner d'ordres urgents, Il a également fait intervenir le ministère public ou toute partie intéressée pour protéger un mineur lorsque cela était nécessaire.

|a أولى المشرع الجزائري اهتماما خاصا بقضايا شؤون الأسرة في قانون الإجراءات المدنية والإدارية، حيث خصها بباب كامل وضح فيه الإجراءات القضائية المتبعة في فض المنازعات الخاصة بالأسرة، وموضحا سلطات القاضي في قضايا الطلاق والولاية على القاصر والنسب والكفالة والتركة، رغبة منه في تفعيل الحماية القضائية للأسرة بصورة عامة، والقاصر أو ناقص الأهلية بصفة خاصة باعتباره الطرف الضعيف فيها، كما أن المشرع عمد لتوسيع صلاحية القاضي حيث أجاز له التدخل تلقائيا دون الحاجة للطلب لإصدار أوامر ذات طابع استعجالي، كما جعل النيابة العامة أو كل من يهمه الأمر يتدخل لحماية لقاصر عند الضرورة.
