This study aims to examine one of the problems posed by the process of artificial fertilization , in an attempt to collect, arrange and bring together the legal and religious texts in order to facilitate the examination and scrutiny by the legal and religious specialists. The artificial fertilization in itself is one of the most important medical innovations of our time. it comes to the minds of those who follow its development, its multiplicity of fields and its renewing discoveries to study the legal and religious provisions. These questions are not just fiction, but we hear and watch them through social media. Among these question that we tried to address in this study is the issue of external artificial fertilization from the brain-dead person and the related provisions. Cette étude vise à examiner l'un des problèmes posés par la fécondation artificielle sur le processus de la scène, pour tenter de recueillir et d'organiser et de mettre la légitimité et les textes juridiques afin de faciliter le processus d'examen et de contrôle de la population de la compétence de la fécondation légitime et légal, et comme artificielle en elle-même l'une des principales calamité médicale à l'heure actuelle, il vient à l'esprit de ceux qui suivent son développement et la multiplicité des domaines de découvertes renouvelables et la recherche dans les dispositions légitimes et légales, ces problèmes ne sont pas pure fiction, mais nous en entendons parler, et nous voyons à travers les moyens de communication, et ces problèmes que nous avons essayé de les aborder dans cette étude: la question de L'insémination artificielle en dehors des dispositions décédées et liées au cerveau. تهدف هذه الدراسة إلي البحث في أحد الإشكاليات التي تطرحها عملية الإخصاب الاصطناعي علي الساحة، في محاولة لجمع وترتيب وتقريب النصوص الشرعية والقانونية بغرض تسهيل عملية النظر والتمحيص لأهل الاختصاص الشرعي والقانوني، وباعتبار الإخصاب الاصطناعي في حد ذاته أحد أهم النوازل الطبية في وقتنا الحالي، فإنه يتبادر إلي أذهان متابعي تطوره وتعدد مجالاته واكتشافاته المتجددة البحث في الأحكام الشرعية والقانونية، هذه الإشكاليات ليست محض خيال بل أننا نسمع عنها ونشاهدها عبر وسائل التواصل، ومن بين هذه الإشكاليات التي حاولنا معالجتها في هذه الدراسة: مسألة الإخصاب الاصطناعي الخارجي من المتوفي دماغياً والأحكام المتعلقة بها. |
