تأتي أهمية هذا البحث بكونه يكشف ما تمتاز به الشريعة الإسلامية من خصائص تتجلى في ثبات أحكامها، مع مرونتها وصلاحها لكل زمان ومكان، كما أنه يعد من الموضوعات المتفق عليها بين المذاهب الفقهية الأربعة، كما أنه من خلال تحريره يسهم في تقديم الحلول للمشكلات التي تواجه المشتغلين بالفتوى. ويهدف البحث لتحرير أسباب تأثر الفتوى بالعرف، وتحديد ضوابط ذلك التأثر التي تمنع من الإفراط أو التفريط في هذا المجال، سواء تعلقت بالمفتي أو غيره. وبين البحث أن أسباب تأثر الفتوى بالعرف هي: 1- تغير الزمان، والمقصود به تغير عادات الناس في زمان ما عن عادات الناس في زمان آخر، أو في الزمن الأول وتغير الزمان شامل لفساد الزمان، أو صلاحه. 2- تغير المكان، والمراد به المكان الذي انتشر فيه العرف السابق، ثم تغير العرف في المكان الجديد، فلكل مكان عرفه، في التعامل. 3- تغير الأحوال، والمراد تغير ظروف وأحوال الناس. وأما الضوابط فنوعان: ضوابط عامة، وتشمل: عدم مخالفة النص الشرعي الصريح، وأن يكون العرف منتشراً وغالباً، وأن يكون التغير ثابتاً وواضحاً، وأن يكون التغيير موافقاً لمقاصد الشريعة. وضوابط خاصة، وتشمل: الضوابط الخاصة بالمفتي، والضوابط الخاصة بالحكم، والضوابط الخاصة بأحوال الحكم. وقد أبرز البحث أن تغير الأحكام الاجتهادية أحد خصائص الفتوى التي تدع على عظمة هذا الدين، وصلاحه لكل زمان ومكان.

And special controls, including: controls for the Mfti, and controls for governance, and controls on the conditions of governance. The research highlighted that the change of judgment judgments is one of the characteristics of the fatwa which indicates the greatness of this religion, and its validity for all times and places.
