المستخلص: هذا البحث متعلق بمسألة مهمة وهي مسألة العوامل المؤثرة في تغير الفتى في الشريعة الإسلامية، لأنه من المقرر أن الشريعة الإسلامية – حفظها الله – راعت أحوال المكلفين وظروفهم وملابسات وقائعهم، فلم تأت أحكام الشريعة مجرد قوالب جامدة لا يراع فيها الظروف التي تحيط بالمكلفين، بل على العكس من ذلك جاءت أحكام الشريعة مرنة واسعة تراعي أحوال المكلفين وما يحيط بهم من ظروف خاصة قد تجعل الحكم الشرعي متغيرا حسب هذه الظروف ومراعاة لهذه الملابسات، بل لعلي أن أذهب إلى ما هو أبعد من هذا فأقول إن النصوص الشرعية نفسها أنزلها الله – تعالى – باللغة العربية حتى تكون حمالة لأوجه متعددة يستطيع المجتهدون تفسيرها واستنباط أحكام متعددة من النص الواحد بما يلائم أحوال المكلفين. ومن جملة الأشياء المؤثرة في تغير الفتوى هو تغير الزمان والمكان، فللزمان والمكان اعتبار في الفتيا، فما يصلح من فتيا في زمن معين قد لا يكون صالحا للتطبيق في زمن آخر وما يصلح لمكان معين قد لا يصلح لغيره، والواقع يؤيد ذلك، وقد ورد في البحث أمثلة كثيرة على ذلك، وهذا في نظري أمدح ما مدحت به الشريعة الإسلامية أنها مرنة تسع بنصوصها وأحكامها وفتواها كل زمان ومكان. وقد استعمل الباحث المنهج الاستقرائي التحليلي في بيان علاقة الزمان والمكان بالفتيا من حيث تغيرها بهما، وتحليل ذلك تحليلا شرعيا مناسبا. وتوصل الباحث إلى عدة نتائج لعل أهمها: أن للزمان أثره الواضح في تغير الفتوى، وأن للمكان نفس هذا الأثر، وصلاحية الشريعة الإسلامية للتطبيق في كل زمان ومكان، وأن الشريعة الإسلامية لم تضق يوما ولن تضيق أن تسع الناس جميعا على اختلاف ظروفهم وأحوالهم وأزمانهم وأماكنهم. والله أعلم.

Rather, I have to go beyond this. I say that the same legal texts were revealed by God Arabic to be protected Its multiple aspects Diligent can interpret and derive multiple provisions from one text to suit the conditions of taxpayers. Among the things that affect the change in the fatwa is the change in time and place. For time and place, it is considered as a fatwa. What is valid for a young woman at a particular time may not be valid for another time, and what works for a particular place may not be suitable for others. There are many examples of this. In my opinion, I commend the praises of the Islamic Shari'a that it is flexible, with its texts, rulings and fatwas in every time and place. The researcher used the analytical inductive method in the statement of the relation between time and space in the fatia in terms of changing them by saving the mind, and analyzing it with appropriate legal analysis. The researcher reached several results, the most important of which is that time has a clear effect on changing the fatwa. The place has the same effect, and the validity of Islamic law to be applied at all times and places, and that Islamic law has never narrowed and will not narrow. God knows
