المستخلص: There is no doubt that the criminal motives and the tragic effects of medical research on the human body have mobilized the international community judicially and even technically, and has accelerated the development of safeguards against to prevent his humiliation in respect to his dignity and body. This emanated from the pronouncement of the “Nuremberg” Court and the “Helsinki” World Medical Association Declaration, which are considered to be the initial texts which were relied upon to build a fence of guarantees which were established for the moral legitimacy of medical research on the human body, which were blessed by the World Health Association as a purely technical international institution, in the context of public health, in addition to UNESCO and what it seeks in terms of consolidating the academic aspect in the field of medical research. This is what the comparative health legislation responded to in relation to the need to regulate and frame the subjects of medical researches and the special approval of the volunteer connected to them. That is in addition to embodying them in the frame of a protocol that is subject to approval, control and being tracked by independent and special committees of multiple competencies.

Sans aucun doute que les motifs criminels et les effets tragiques des recherches médicales sur le corps humain ont Stimulé la communauté internationale sur le plan judiciaire et même technique, et ont accéléré l'établissement de garanties qui protègent l'être humain dans son corps sa dignité. c'est ce qui ressort du procès Nuremberg et de la Déclaration de Association médicale mondiale qui élaborent les premiers textes garantissant l’établissement de la légitimité morale de la recherché médicale sur le corps humain et qui sont étés reconnues par l'organisation mondiale de la Santé comme une institution international purement technique dans le cadre de la santé, ainsi l'UNESCO don’t parmi ces objectifs consacrer et consolider l'aspect académique de domaine de La recherche médicale, c'est ce que la legislation comparatives en matière de santé a répondu dans la nécessité de contrôler et d'encadrer les thèmes de recherche médicale et d’assurer un consentement spéciale du bénévole concerné, ainssi que traduire la recherche dans le cadre d'un protocole qui peut être approuvé et contrôler par des comités indépendants et multidisciplinaires.

مما لا شك فيه أن الدواعي الإجرامية والآثار المأساوية للبحوث الطبية على جسم الإنسان حركت المجتمع الدولي قضائيا وحتى فنيا وعجلت في وضع ضمانات تحول دون اهانته في كرامته وجسده، وهوما انبثق عن منطوق محكمة "Nuremberg" وإعلان الجمعية الطبية العالمية بـ "Helsinki" التي تعتبر من النصوص الأولى التي ارتكز عليها في بناء سياج من الضمانات التي تؤسس لشرعية أخلاقية للبحوث الطبية على جسم الإنسان والتي باركتها "المنضمة العالمية للصحة" كمؤسسة دولية فنية محضة في إطار الصحة العامة بالإضافة إلى اليونسكو وما ترمي إليه من تكريس وترسيخ الجانب الأكاديمي في مجال البحوث الطبية، ذلك ما استجابت له التشريعات الصحية المقارنة في ضرورة ضبط وتأطير مواضيع البحوث الطبية والموافقة الخاصة للمتطوع المتعلق بها، بالإضافة إلى تجسيدها في إطار بروتوكول قابل للإجازة والرقابة والتتبع من طرف لجان خاصة مستقلة ومتعددة الكفاءات.
