يهدف هذا البحث إلى إيجاد نوع من التوازن بين مبدأ حرية الصحافة وحق المجتمع في الإعلام من ناحية، وحق الإنسان في صورته من ناحية أخرى، فالصحافة تعد التجسيد الأمثل لحق التعـبير عـن الـرأي، كما أن الحق في الـصورة يخول صاحبه سلطة الاعتراض علـى إنتاج صورته أو نشرها حتى لو تم هذا الأمر في إطار ممارسة مهنة الصحافة، وقد ثبت من خلال هذا البحث أن هذا التوازن يقوم على فرض بعض القيود التي تحد من الحق في الصورة لصالح الحق في الإعلام، وذلك كرضا الشخص المعني بإنتاج صورته أو نشرها، وكذلك حق المجتمع في الإحاطة بالوقائع العلنية وما يدور من أحداث تتعلق بالنشاط المهني للشخصيات العامة والشهيرة، وفي المقابـل يقتضي هذا التوازن تقييـد الحق في الإعـلام تجاه الحق في الصورة، حيث يتعين أن يتقيد الحق في الإعلام بـضرورة المحافظة علـى كرامة الشخص الذي تمثله الصورة، فإذا تجاوزت الصحافة حدود الحق الممنوح لها فإنه يحق لمن اعتدى على حقه في الصورة اللجوء إلى القضاء، طالبا الحماية - بشقيها الإجرائي والموضوعي - التي أسبغها المشرع على الحقوق اللـصيقة بالشخصية، حيث اتفق الفقه والقضاء على أن هـذه الحماية تنطبق على الحق في الصورة، على اعتبار أن هذا الحق ينتمي لهذه الطائفة من الحقوق.
