|a إن الفساد (Corruption) مصطلح يتضمن معاني عديدة في طياته. والفساد موجود في كافة القطاعات الحكومية منها والخاصة، فهو موجود في أي تنظيم يكون فيه للشخص قوة مسيطرة، أو قوة احتكار على سلعة أو خدمة، أو صاحب قرار. وتكون هناك حرية في تحديد الأفراد الذين يستلمون الخدمة أو السلعة، أو تمرير القرار لفئة دون الأخرى، وبالتالي فان هذه الظاهرة تتخذ أشكالا متعددة. وعلى اعتبار أن الفساد الذي تشهده الوظيفة العامة يشكل عقبة في سبيل تحقيق التنمية في الدولة، كان لابد من الوقوف على معناه لضبط مفهومه، وبالتالي اتضاح معالم هذه الظاهرة التي يراد مكافحتها، إضافة إلى أن وضع تعريف واضح للفساد في الوظيفة العامة يعتبر الخطوة الأولى لدراسة هذه الظاهرة ومكافحتها، وكذلك الوقوف على أشكال الفساد في الوظيفة العامة، إضافة إلى التعرف على أسبابه، ودوافعه، والآثار الإدارية للفساد الناشئة بسببه؛ بغية التوصل إلى نتائج ملموسة يمكن أن تساهم في مكافحته، وذلك عن طريق آليات حكومية معينة، ومن ثم يتم تحقيق غاية الوظيفة العامة، وهي إشباع مختلف حاجات الأفراد، وبيان ذلك في أربعة مطالب، على النحو التالي: المطلب الأول: تعريف الفساد في الوظيفة العامة. \nالمطلب الثاني أشكال الفساد في الوظيفة العامة.\nالمطلب الثالث: أسباب الفساد في الوظيفة العامة، ودوافعه. \nالمطلب الرابع: الآثار الإدارية للفساد في الوظيفة العامة.

|f Corruption is a term having many meanings. Corruption is prevalent in all public and private sectors. It is found in any organization in which a person has a controlling power, or monopoly over any commodity or service, or a decision-maker. They have freedom to choose the individuals who will receive the service or the commodity, or pass the decision in favour of one category on the expanse of the other, and therefore this phenomenon takes many forms. Considering that corruption in the public service constitutes an obstacle to the achievement of development in the State, it was necessary to identify its meaning in order to regulate its concept and thus clarify the features of this phenomenon, which is to be combated. In addition to that, a clear definition of corruption in the public service is considered the first step to study and combat this phenomenon, as well as to identify forms of corruption in the public service, in addition to identifying its causes, motivations and administrative effects of corruption arising from it, with a view to achieving concrete results that can contribute to combating it, through certain governmental mechanisms, thus to achieve the objective of the public service, which is to satisfy the various needs of individuals.
