|a يهدف البحث إلى دراسة الوهم وأثره في الاجتهاد الفقهي من خلال التعريف بالوهم، والمقارنة بينه وبين الألفاظ ذات الصلة، ومحاولة سبر اختلاف الفقهاء عند استعماله أو إهماله، وبيان قاعدة (لا اعتبار بالوهم)، في سياق استعمالات الفقهاء والأصوليين في سعي لاستخلاص ضوابط لاستعمالات الفقهاء للوهم، إلى جانب محاولة بيان مدى تأثير ذلك مقاصدياً.\nوقد اعتمد الباحث المنهج الوصفي التحليلي، والمنهج الاستقرائي في تتبع مفردات الوهم واستعمالات الفقهاء له في شتى الأبواب الفقهية.\nوقد توصلت الدراسة إلى أنه لا اعتبار بالوهم لابتناء الشريعة على الحقائق، واستعمالات الفقهاء للوهم إنما كان في مقام الاحتياط وبراءة الذمة ومقام جلب اليقين، وأما في الجانب المقاصدي فإنه لا يصلح أن يكون الوهم محققا لمقصد شرعي في ذاته، وإن كان يمكن أن يكون مقصودا لغيره في الدعوة والموعظة والترغيب والترهيب.\nوقد قُسم البحث إلى مقدمة وثلاثة مباحث، المبحث الأول: بيان مفهوم الوهم والاجتهاد، والمبحث الثاني: حكم الوهم وضوابطه، والمبحث الثالث: علاقة الوهم بالمقاصد وأثره في الاجتهاد الفقهي.\nثم انتهى البحث إلى الخاتمة وأبرز النتائج وتوصية، يليها قائمة بالمصادر والمراجع.

|f The research aims to study the illusion (Wahm) and its impact on the jurisprudence by providing it’s identification and comparing it with related words. It also attempts to explore the difference of Fuqaha' when using it or neglecting it, and explaining the rule of “illusion has no validity”, in the context of its use by the Fuqaha' and scholars of principles of Fiqh to draw controls over the use of illusion by Fuqaha', as well as to try to explain the extent of its effect purposefully.\nThe researcher has adopted the descriptive-analytical and inductive approaches in following the vocabulary of illusion and its use by the Fuqaha' in various chapters of Fiqh.\nThe study concluded that the illusion has no validity due to the fact that sharia is based on the facts. The Fuqaha's use of illusion happens only in the places of precaution, clearance and bringing the certainty. With regard to the purposeful side, it is not appropriate for the illusion to help achieve any purpose Shariah in itself. However, it may be purposeful in other fields such as preaching, instructing, inviting and intimidating (for bringing people closer to Allah).\nThe research was divided into an introduction and three chapters. The first chapter deals with the concept of illusion and Ijtihad. The second chapter deals with the ruling on illusion and its rules. The third chapter discusses the relationship of illusion with the purposes and its impact on the Ijtihad in Fiqh.\n\nThe research then concluded and highlighted the findings and recommendations, followed by a list of sources and references.\nThis abstract translated by Dar AlMandumah Inc. 2018
