المستخلص: هذا البحث يتناول موضوع الاستقلال الشخصي في أهم قضايا الأسرة من حيث: اتخاذ القرار من قبل أحد الأولياء بالتزويج للمرأة دون الرجوع إلى بقيتهم، وكذا استقلال بالولاية على طرفي عقد النكاح، ثم استقلال المرأة لتزويج نفسها دون إذن وليها، ثم تزداد أهمية هذا البحث في الاستقلال الشخصي في قضايا فسخ العقد، فإذا ظهر لأحد الأولياء أن هذا الزوج ليس كفئا للمرأة أو أن فيه عيبا فاستقل بطلب فسخ العقد، وكذا الفسخ بسبب دعوى الزوج أو الزوجة رضاعه مع الآخر، ومما يكون له حكم الاستقلال الشخصي استقلال الزوج بالظهار من زوجته بما هو محرم عليه مؤبدا، ثم تزداد أهمية هذا البحث في الاستقلال الشخصي في قضايا الطلاق فيستقل به الزوج دون الزوجة لما يترتب عليه من تبعات الطلاق من النفقة والسكنى والعدة والرضاع والحضانة إن كان له ولد، ثم يأتي استقلال الزوجة بالحضانة نتيجة للطلاق الذي يحصل لها من زوجها، ومن أهم قضايا الطلاق تحمل الدولة وقيامها على حضانة الأولاد غير الشرعيين.
إلى غير ذلك من مباحث الاستقلال الموجودة في كتب الفقه.


This research addresses the topic of personal independence in most important family issues in terms of: deciding by one of the guardians to marry off a woman without consulting other guardians as well as independence with guardianship over both parties of the marriage contract, then the independence of a woman to marry off herself without the permission of her guardian. Then this research becomes increasingly important in personal independence in cases of contract termination. If it appears to one of the guardians that this husband is not competent for the woman or he has a deficiency, and he independently requested for the nullification of the contract as well as an annulment because of the husband's or wife's call for feeding (the child) through another (woman). One of the rules of personal independence is the independence of the husband by Zihar (saying his wife, "you are like my mother), which is forbidden for him permanently. Then, this research becomes increasingly important in personal independence in divorce cases. The husband becomes independent without the wife because of the consequences of divorce, including alimony, housing, Iddah (waiting period), breastfeeding, and custody if he has a child. Then comes the wife's independence in custody as a result of the divorce she gets from her husband. One of the most important issues of divorce is the fact that the State holds custody of illegitimate children. There are other independence topics found in the books of jurisprudence.
