المستخلص: In view of the positive and pivotal role that investment plays in reviving and developing economic life through an increase in the domestic product and the provision of additional raw materials complementary to the national savings, as well as its contribution to the transfer of technologies from one country to another, Algeria, aware of this, has sought to draw and attract investment, by improving its climate and providing various guarantees and incentives for foreign investors in general and Maghreb investors in particular. In this regard, Algeria has concluded several Maghreb bilateral agreements, such as the Algerian agreement with the Arab Maghreb Union in 1990 on the promotion and guarantee of investments, as well as the Algerian-Tunisian agreement of 2006 on the encouragement and mutual protection of investments.
The goal through these agreements revolved around reconsidering the tax and customs systems and facilitating the movement of capital and returns resulting from the investment. The task of dealing with investors was also entrusted to the agency to promote, support, and follow up on investment in order to achieve many procedural guarantees and facilitate transactions.
Therefore, through this intervention, we try to answer the following question: To what extent has Algeria, in agreement with the rest of the countries in the Maghreb region, through the conclusion of bilateral agreements, achieved solid ground and guarantees to attract investors and encourage them to enter the Algerian market?
This is answered by addressing the following two points:
The first point: the conceptual framework (investment - types of investment - investment guarantees - the Algerian market).
The second point: Models and contents of the Algerian bilateral agreements with the Maghreb countries in the field of investment guarantees.

بالنظر للدور الإيجابي والمحوري، الذي يلعبه الاستثمار في إنعاش الحياة الاقتصادية وإنمائها من خلال زيادة الناتج الداخلي وتوفير مواد أولية إضافية مكملة للادخار الوطني وكذا مساهمته في نقل التكنولوجيات من دولة إلى أخرى، فإن الجزائر وإدراكا منها لذلك سعت لاستقطاب وجلب الاستثمار، من خلال تحسين مناخه وتوفير مختلف الضمانات والحوافز للمستثمرين الأجانب عامة ومستثمري دول المغرب العربي بصفة خاصة، وفي هذا الصدد عمدت الجزائر لإبرام العديد من الاتفاقيات الثنائية المغاربية مثل الاتفاقية الجزائرية مع اتحاد المغرب العربي سنة 1990 حول ترقية وضمان الاستثمارات وكذا الاتفاقية الجزائرية التونسية لسنة 2006 حول التشجيع والحماية المتبادلة للاستثمارات.
وكان الهدف من خلال هاته الاتفاقيات يتمحور حول إعادة النظر في الأنظمة الجبائية والجمركية، وكذا تسهيل حركة رؤوس الأموال والعوائد الناجمة عن الاستثمار، كما أوكلت مهمة التعامل مع المستثمرين إلى وكالة ترقية ودعم ومتابعة الاستثمار بغية تحقيق العديد من الضمانات الإجرائية وتسهيل التعاملات.
بالتالي من خلال هذه المداخلة نحاول الإجابة عن التساؤل التالي: إلى أي مدى تمكنت الجزائر بالاتفاق مع باقي الدول في منطقة المغرب العربي من خلال إبرام الاتفاقيات الثنائية من تحقيق الأرضية الصلبة والضمانات الكفيلة لجلب المستثمرين وتشجيعهم على دخول السوق الجزائرية؟
ما تتم الإجابة عنه من خلال التطرق للمحورين التاليين:
المحور الأول: الإطار المفاهيمي (الاستثمار -أنواع الاستثمار - ضمانات الاستثمار - السوق الجزائرية).
المحور الثاني: نماذج ومضامين الاتفاقيات الثنائية الجزائرية مع دول المغرب العربي في مجال ضمانات الاستثمار.
