المستخلص: لا شك أن الأراضي الفلاحية التابعة للقطاع العمومي واحدة من أهم ثروات ومقدرات البلاد، حيث تعد محور اللتنمية الاقتصادية والاجتماعية، مما استوجب توجيهها الملائم حسب وظائفها من جهة، واستغلالها العقلاني والمدروس بهدف ضمان الأمن الغذائي واستثمارها وتحقيق الريع من جهة ثانية، لأجل ذلك استأثرت الدولة بملكية هذه الأراضي وضمتها إلى أملاكها الخاصة، وسطرت لها أحكام خاصة تؤطر كيفيات استغلالها وحمايته. أو لعل التنصيص على نمط منح الامتياز كأسلوب حصري ووحيد لاستغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، يمثل وسيلة قانونية وحيدة مكرسة بعقد الامتياز المبني على دفتر شروط محدد بدقة، يتضمن في متنه كافة الحقوق والالتزامات، بما يؤمن للمستثمر الفلاحي الوضوح في استغلال الأرض وتجسيد استثماراته، وهو ما ينعكس إيجابيًا بالتأكيد على الاستثمار الفلاحي.

There is not doubt that agriculture lands belonging to public sector are one of the most important resources of the country, as it considered as the axis of economic and social development which required, proper guidance according to its function, on one hand, and rational as well as well examined (studied) exploitation for the sake of ensuring food security and investment and to achieve rents on the other hand. For that, the state has appropriated the ownership of these lands and (join) annexed them to its private property, and it has ruled some specific provisions that frame the ways of exploiting and protecting them. It is possible that the mode of granting concessions as a unique and an exclusive way to exploit the agricultural lands belonging to the private property of the state represents a unique legal means dedicated to the concession contract based on a well concised condition book (note book) texted around all rights and obligations. The latter assure the peasant investor clarity in his exploitation of lands and embodiment of investments, which is positively reflected on agricultural investment.
