المستخلص: أقرت الشريعة الإسلامية أسس شرعية لعمليات نقل وزراعة الأعضاء البشرية وهي حالة الضرورة التي يتوجب أن تتوافر على شروط شرعية وأخرى قانونية، يجب أن يتقيد بها الطبيب ويوازن فيها بين مصلحة المريض الذي يكون مهددا بخطر وشيك ومصلحة المتبرع السليم جسديا بعد موافقته ورضاه دون أي إكراه وتبصيره بمخاطر عملية نقل وزراعة الأعضاء البشرية. ورغم الجدل الفقهي والقانوني حول شرعية هذه العمليات لما فيها من مساس بحرمة جسم الإنسان، إلا أنه تم الاتفاق أن هناك أسس شرعية يجب التقيد بها للنقل وزراعة الأعضاء البشرية بين الأحياء أو من الأموات إلى الأحياء، وتم تقرير وضبط شروط حالة الضرورة التي تفرض التدخل الجراحي لعملية نقل وزراعة الأعضاء البشرية وتقرير الموازنة بين حق الإنسان المريض في الحياة وحق السلامة الجسدية للمتبرع من خلال فرض تطبيق الشروط الصارمة لتحقق حالة الضرورة بما يراعى مصلحة المريض والمتبرع ودون المساس بحقوقهم المقررة والمحمية شرعا وقانونا.

The Islamic Sharia legal bases for human organ transplants, if necessary, which are available on the terms of legitimacy and legality, must abide by the doctor and balancing between the interests of the patient who is threatened with imminent danger and the interest of the Proper donor physically after its approval of the Lavon Affair without any coercion of dangers of the process of human organs transplants.
