On the authority of Abu Hurayrah, he said: The Messenger of Allah said: ((until it is set up in, the land is better for the people of the earth than to rain at forty in the morning)). And it causes people to be as ignorant as they were of immorality, and one of my goals in this research:- 1-To show the supremacy of Islamic law and its superiority over the rest of the laws, as well as its mercy towards people. 2- Knowledge of the provisions of the legitimacy of the issues of border overlap in Islamic jurisprudence. 3- A statement dealing with the law of the overlap side of the border and the clarification of evidence and judgments 4- Prove that Islamic Sharia is valid for all times and places. I ask God to bless us with Islam and to give us Muslims and to follow us with the righ-teous.
خلق الله سبحانه وتعالى العباد وأرسل إليهم رسله وأنزل عليهم كتبه ورضي لهم الإسلام دينا، وجعل لهم أجلاً مسمى، وأمرهم بعبادته وطاعته وطاعة رسوله صلى الله عليه وسلم وجعل حدوداً وأمر بالوقوف عندها، وجعل حفظ الضروريات من أصول الدين ومقاصد شرع الله الحكيم، فكانت الحدود في الشريعة الإسلامية قائمة على هذا الأساس فهي حاجزة للظلم وأعظمه الشرك بالله. وعن أبي هريرة رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم: (لحد يقام في الأرض خير لأهل الأرض من أن يمطروا أربعين صباحاً).(2) فيحدث للناس فجور بقدر ما أحدثوا من الفسوق، والله أسأل أن يحيينا على الإسلام وأن يتوفنا مسلمين وأن يلحقنا بالصالحين. أهداف البحث: -1 العلم بالأحكام الشرعية المتعلقة بمسائل تداخل الحدود في الفقه الإسلامي. -2-بيان تناول الشريعة لجانب التداخل في الحدود وتبيين الأدلة والأحكام. -3-إثبات أن الشريعة الإسلامية صالحة لكل زمان ومكان.
