المستخلص: افتتحت الدراسة بمقدمة تضمنت إشارة إلى فريضة الحج، وكونها فرصة أتاحها الله لعباده يتجمعون لها في بقعة مقدسة من العالم متجردين من مظاهر الدنيا وعوالقها ليفيض عليهم من فضله وبره ورحمته. وبين البحث أن الدافع لدراسة القضية وجود بعض علامات المشعر دون الحد الشرعي له ، بما يعني أن العلامات المحددة للمشعر قد استبعدت أجزاء منه. كما أن بالمشعر أجزاء تقع داخل حدوده ولا يمكن الانتفاع بها ، وهذا وضع لا يصح الآن. وضم المبحث الأول حديث المعاجم اللغوية وكتب الفقه والتاريخ عن كلمة مزدلفة، والأسماء الأخرى للمشعر (جمع، المشعر الحرام) وبيان السر في تسمية المشعر بهذه الأسماء، ومقصود التسمية بكل منها. وحوى المبحث الثاني حديثا عن موقع مزدلفة، وحدودها، وطبيعة سطحها، ومساحتها، مبينا ما ورد من أقوال علمائنا مما يتح لنا ضم أجزاء من الأرض إلى المشعر دون تجاوز حدوده الشرعية، محددة مساحة تلك الأجزاء بالأرقام.
سلط المبحث الثالث الضوء على بعض الدراسات الحديثة التي ترى ضم حوالي سبعة كيلومترات مربعة إلى مساحة مزدلفة من الجهة الشرقية لتصل حدودها من هذه الناحية إلى آخر حدود الحرم المكي شرقا ناحية عرفات. وتمت مناقشة هذه الدراسة في ضوء النصوص المعتبرة، وخلصت الدراسة إلى أن الأدلة التي استند إليها الباحث الكريم لا تقوى على إثبات ما أراد، وكم وددنا لو أمكنه ذلك، ولكننا ننتظر ونحث على القيام بدراسات أخرى علنا نصل إلى هذا الهدف الذي لو استطعنا إثباته لحلت مشاكل كثيرة ولرفع عنا عنت كبير نعانيه ويعانيه الحجج. لذا فإن المزيد من البحث والتقصي ضروري.
وختمت الدراسة برؤية الباحثين ومقرحاتهما التي ترفع الطاقة الاستيعابية لمشعر مزدلفة من منطلق علمي وعملي وتنظيمي، دون إهدار للنصوص الشرعية والعلمية الموروثة، فإزالة الجبال التي تجثم على أرض مزدلفة، وضم سفوح الجبال الشمالية والشرقية إلى مزدلفة وهي التي تسيل مياهها في مزدلفة عمل يضيف إلى مزدلفة مساحة كبيرة إذ تصل هذه المساحة التي تضاف إلى ما يقرب من 80% من المساحة المتاحة حاليا للنوم والصلاة، وإتاحة الفرصة للحجاج المالكية للوصول إلى المزدلفة والدفع منها قبل الحجاج الآخرين، وتأخير وصول الحجاج الأحناف ليكونوا آخر الحجاج وصولا إليها كل هذا يرفع الطاقة الاستيعابية لمزدلفة، وهذا هو المراد.
وختمت الدراسة بالدعوة إلى أن يكون الحريم التي نادت بضربه حول مزدلفة وقفا على المشعر والحجيج، تماما كما هو حال المشعر نفسه؛ لكي لا يلحق أرضه أي نوع من التعدي من أفراد أو مؤسسات أو حتى جهات حكومية، وأوضحت الدراسة فوائد هذا الحريم وعلة فرضه في الجهة التي حددتها.
وبعد فهذه دراسة نقدمها بين أيدي العلماء والدارسين راجين أولا القبول من المولى عز وجل، وثانيا أن تحظى باهتمام الباحثين مناقشة وتصويبا وإكمالا، لما لموضوعها من أهمية حيث يتعلق بأحد مشاعر فريضة هي أحد أركان الإسلام الخمس. والله من وراء القصد، وهو الهادي إلى الصواب.

The study was started with an introduction that included a reference to the obligatory pilgrimage (Hajj), and that it was an opportunity provided by God for His servants to gather for it in a holy place of the world, stripped of the manifestations of the world and its planktons to send over them from His generosity, virtue, and mercy. The research showed that the motive for studying the case was the presence of some signs of the Monument without the Shari limit, meaning that the specific signs of the Monument had excluded parts of it. The Monument also has parts that are within its borders and cannot be used, and this is a situation that is not valid now. The first subject includes the discussion of linguistic dictionaries, books of fiqh and history on the word Muzdalifah, other names of the Monument (Jamah and the Holy Monument), and the secret of naming the Monument by these names, and the meaning of naming by each of them. The second subject included the discussion about the location of Muzdalifah, its borders, the nature of its surface, and its area, indicating the statements of our experts, which allows us to combine parts of the land to the Monument without exceeding the limits of sharia, specifying the area of those parts by numbers.
The third subject sheds light on some recent studies on the annexation of about seven square kilometres to the area of Muzdalifah from the eastern side to reach the end of the Mecca Mosque in the east towards Arafat. This study was discussed in the light of the recognized texts, and the study concluded that the evidence relied upon by the noble researcher cannot prove what he wanted. Many times we have wished if it was possible, but we are waiting and urging that further studies be carried out in order to reach this goal, which, if we could prove, would have solved many problems and lifted from us a great suffering and suffering of the pilgrims. Further research and investigation are, therefore, necessary.
The study concluded with the view of the researchers and their suggestions that raise the absorptive capacity of Muzdalifah monument from a scientific, practical and organizational point of view, without wasting the legit and scientific inherited texts. The removal of the mountains that rest on the land of Muzdalifah, and the annexation of the hills of the northern and eastern mountains to Muzdalifah, which is running water in Muzdalifah, is an act that adds to Muzdalifah a lot of space. This area, which is added to approximately 80% of the space currently available for sleeping and for prayer. It will give the opportunity for Malikiyah pilgrims to reach Muzdalifah and return from there before the other pilgrims, and delaying the arrival of Hanafi pilgrims to be the last pilgrims to reach Muzdalifah, all of this raises the capacity of Mzdalifah, and this is what is intended.
The study concluded by calling for the harem to be expanded around Muzdalifah to be a Waqf (an endowment) for the Monument and the pilgrims, just as the case of the Monument itself, in order not to inflict any kind of encroachment on its territory by individuals, institutions or even government agencies. The study explained the benefits of this harem and the reason for inflicting it in the field it specified.
This is a study we offer in the hands of academics and scholars, expecting, first of all, from Allah the Almighty to accept it, and secondly, to receive the attention of researchers to discuss, correct, and complete, because of its importance as it relates to one of the obligatory activities that is one of the five pillars of Islam. Allah is the one who knows what is behind the intention and He guides to the right path.
