|a لا تثير كفاية أموال المدين عند توزيعها على الدائنين أي مشكلة، لكن يتغير الحال عند عدم كفايتها وتزاحم الدائنين لاستيفاء حقوقهم، وهو ما يثير تحديد مرتبة كل منهم بين دائن عادي ودائن صاحب ضمان. وعند تعدد أصحاب الضمان بين دائن مرتهن، ودائن ممتاز، ودائن صاحب حق اختصاص. فيتقدم أصحاب حق الأولوية من أصحاب الضمان على الدائنين العاديين، ومن ثم يتقدم أصحاب حق الامتياز على غيرهم من الدائنين، ويتقدم أصحاب حق الامتياز الخاص، على أصحاب حق الامتياز العام. ومن ثم يتقدم صاحب حق الاختصاص على غيره بعد أصحاب حق الامتياز، ومن ثم يتقدم الدائنون المرتهنون على الدائنين الأخرين. ويتقدم أصحاب الأولوية الموضوعية على أصحاب الأولوية الإجرائية ما لم يكن صاحب الأولوية الإجرائية سابق في وجوده على الأولوية الموضوعية فيتقدم. ويتقدم أصحاب الأولوية الإجرائية على الدائنين العاديين.
