المستخلص: تتضمن الوسائل الاختيارية لحل المنازعات عبر الشبكة، آليتي التفاوض والوساطة، ويعدان من وسائل حل المنازعات النابعة من إرادة الأطراف، لأنها تعطي الأطراف حرية تبني أو رفض الحل النهائي للألية سواء كانت إيجابية أم لا، لأي من الطرفين. وفي الوساطة الإلكترونية، يتوسط شخص ثالث ليساعد الأطراف على التوصل إلى اتفاق يرضيهم جميعا، وذلك دون إن يكون له صلاحية حسم النزع بل مهمته تنحصر لتقريب وجهات النظر تمهيدا لحل النزع، ويكون على الوسيط إن يحافظ على مبدأ حسن النية طوال مدة سريان الإلية، ويتوقف إطلاق آلية الوساطة الإلكترونية على موافقة الطرف الأخر على المشاركة في الإلية، وتعيين وسيط بشكل قانوني وصحيح عبر الشبكة إضافة إلى ضمان الثقة والسرية في جمع مراحلها.

The whole world progresses and develops as a result of the information and communication revolution that goes beyond imagination with its techniques. from this informative many application had resulted that affect the aspects of the Economic and social activities.one of these aspects is the appearance of the electronic commerce with its different issues. with the diffusing of using information and communication techniques to accomplish the legal papers. There are a tendency towards setting these issues by using the same techniques so the settlement would be electronic that is to say the procedures would be through the electronic communication net. Constitute the mediation and means of amicable dispute resolution, where the parties to the conflict to work with the mediator , one of the offers advice and guidance , with the introduction of the possibilities that may be deemed a party to the conflict accepted should have been in good faith at all stages of the course of the mediation process , and should respect the principle of consensual in all phases stages of mediation, the solution back to the parties to the conflict , while confined to the role of mediator to facilitate the communication only, what is meant mediation...? Although mediation depends on the intervention of a third person, the arbitration and conciliation and conciliation Agency and the judiciary also requires the intervention of a third person.
