المستخلص: الحمد لله رب العالمين، والصلاة والسلام على سيدنا محمد -صلى الله عليه وعلى آله وصحبه أجمعين-وبعد .فهذه دراسة حول (قراءة صحيفة المدينة في ضوء فقه المواطنة -دراسة دعوية (للقيام بالنظر في الصحيفة باعتبارها أقدم ميثاق بشري یخول لجماعة بشرية -مختلفة الاتجاهات الدينية والأعراق- بغرض العيش المشترك في حدود الوطن الواحد، مع الإنفاق والدفاع المشتركين في تسامح وتراحم. ومن دوافع دراسة هذا الموضوع، مایلي: أولا: وضع ركائز أساسية لإثبات صحيفة المدينة، لإغلاق الباب في وجه المشككين في ثبوت الصحيفة، سواء بالموافقة للكتاب والسنة، مع بيان وجه الاستدلال، وبيان مناسبة الصحيفة لمنطق راجح في العقل، وهذا يجلي عن منزلة الصحيفة العلمية، والشرعية، بل والتاريخية، وهذا أمر يعد فريضة شرعية اليوم؛ لبيان تصور النبي للمواطنة، وبيان حقيقة الإسلام للدفاع عنه مما يلصقه الأعداء به ظلما وعدوانا. ثانيا: التأصيل الشرعي للمواطنة حيث بات فريضة دينية وضرورة اجتماعية، فكان المسلمون على مدار قرون الإسلام الأولى يعيشون في البلاد التي فتحوها بتسامح وتراحم، حتى طرأ على الأمة المسلمة عوامل – داخلية وخارجية – عمقت من الفكر الطائفي وفعلت سلوكيات طائفية من كافة الأطراف والأطياف والطبقات، مما يدعو اليوم لضرورة القيام بتأصيل شرعي لمصطلح (المواطنة)، فعلماؤنا الأولون لم يضطروا لهذا التأصيل لرسوخ المواطنة بعقل ووجدان المسلمين، لكونها سلوكا عمليا في العرف العام للمجتمع، والذاكرة الإسلامية تعج بكثير من الذكريات الداعمة لها، وأما العلماء اليوم فمضطرون للبحث عن هذا التأصيل؛ لأن المواطنة مصطلح جديد في أدبيات المسلمين، ومسماه ومعناه موجود، وصحيفة المدينة خير شاهد عليه. ثالثا: رد الشبهات ودفع الإشكالات، حول دولة الرسول بالمدينة، أو حول بعض فقرات الصحيفة، مستعينا في ذلك بمنهج علمائنا في الجمع بين الأدلة بتقييد للمطلق، أو باحثا في آراء العلماء (صلى الله عليه وسلم) لاختيار أقوى الأقوال دليلا، وأنسبها استدلالا مع الواقع المعاصر من فقه المواطنة، قدر الجهد. لذلك كانت) صحيفة المدينة (ولا شك-الخبر الدال على معاني المواطنة الراقية؛ إذ تحمل دلالاتها النصية ما يقيم أركان الدولة من تنصيب حاكم وبناء وطن له حرمة، وحقوق، وواجبات، وبيان ما للمواطن من حقوق، وواجبات؛ لبيان موقف الإسلام من) المواطنة) وقضاياها. وتتكون الدراسة من مقدمة وثلاثة فصول، وخاتمة. أما المقدمة فشملت: أسباب اختيار الموضوع، والإشكاليات، والأهداف، والدراسات السابقة، والمنهج، والخطة. الفصل الأول بعنوان: (صحيفة المدينة -دراسة وصفية (، ويتكون من المباحث التالية: المبحث الأول: مدخل لدراسة صحيفة المدينة. المبحث الثاني: صحيفة المدينة بين التسمية والوصف. المبحث الثالث: صحيفة المدينة بين تحديد الزمان والمكان. المبحث الرابع: نص صحيفة المدينة • المبحث الخامس: المنزلة العلمية لصحيفة المدينة. الفصل الثاني: (صحيفة المدينة وفقه المواطنة (، ويتكون من المباحث التالية: المبحث الأول: مدخل إلى فهم المواطنة• المبحث الثاني: المسئولية العامة في ضوء الصحيفة. المبحث الثالث: بناء الوطن في ضوء الصحيفة. المبحث الرابع: حقوق المواطن وواجباته في ضوء الصحيفة• المبحث الخامس: دوائر المواطنة في الإسلام. الفصل الثالث: (إشكاليات وشبهات حول صحيفة المواطنة (، ويتكون من المباحث التالية: المبحث الأول: إشكالية الدولة الدينية. المبحث الثاني: إشكالية نفي قتل المؤمن بالكافر. المبحث الثالث: إشكالية نفي نصرة الكافر على المؤمن. المبحث الرابع: إشكالية نسخ الصحيفة بأحكام الشريعة. المبحث الخامس: شبهات وإشكاليات أخرى حول الصحيفة. وفي الخاتمة: بيان لأهم النتائج التي توصلت إليها، وأهم التوصيات.

It is motivated by the study of this subject: First: the establishment of basic pillars to prove the Al-Madina paper to close the door in the face of skeptics in the confirmation of the paper, whether the approval of the holy qouran and the sounna, with the statement of the inference, or an appropriate statement of the paper to the logic of reason in the mind ,and this reveals the status of the newspaper scientific and legitimate, and even historical, and this is a duty of legitimacy today to demonstrate the truth of Islam on the one hand, and defend it, which is infected by his enemies - unjust and aggressive - on the other. Second: the legalization of citizenship, where it became a religious obligation and social necessity , Muslims throughout the first centuries of Islam lived in the country, which opened them with tolerance and compassion, until the Muslim nation came to the factors - internal and external - deepened sectarian thought of all parties and classes, Today, it is necessary today to legitimize the term "citizenship". Our first minds did not have to root for the establishment of citizenship with the mind and conscience of Muslims, because it is a practical behavior in the general custom of society, and Islamic memory is full of many memories supporting it, As for the scholars today they are forced to search for this rooting; because citizenship is a new term in the literature of Muslims, and its name and meaning exists, and the city newspaper is the best witness. Third: the response of suspicions and the problems, about the state of the Prophet in the city, or about some paragraphs of the paper, Using the method of our scholars to combine evidence by restricting the absolute or researcher in the views of scholars - may God have mercy on them - to choose the strongest evidence, and the most appropriate inference with the contemporary reality of the jurisprudence of citizenship, as much effort. Therefore, I chose Al-Madina newspaper, which is certainly the most important news for the meaning of high-end citizenship, because it carries textual indications that assess the pillars of the state: the installation of a ruler and the building of a homeland that has sanctity, rights and duties , To participate in a study seeking to demonstrate the position of Islam (citizenship) to evacuate the face of truth on the side of the State of the Messenger of Allah - peace be upon him - in Medina , To know the ignorance or ignore, and remember the forgotten, and the people are disciplined by the wisdom of the Prophet and his mercy in the treatment of all people, I took a study (newspaper city), indicating its implications on the jurisprudence of citizenship، Al-Madina paper an important difference in the history of mankind in general, and in the history of Islam and Muslim thought in particular, It is considered the first social contract held by the Prophet, peace be upon him - shows the relationship of the public official to the homeland and citizens. Study Approach: I used (analytical descriptive approach), in a statement concerning Al-Madina paper in terms of name, time of writing, and place, Indicating the pillars of proof of the newspaper, while addressing the comparative approach between the texts of books seerah and money, called for the need to study, and to explain the meanings of vocabulary and strange. As used (analytical approach), the relationship of the newspaper with citizenship as an analysis, showing evidence of authenticity of the holy qouran and the sounna, Indicating the Prophet's vision through the newspaper in building a healthy citizen, and knew citizenship in language and Sharia, pointing to the approval of the concept of Sharia to signify the meaning of citizenship in the language. Study plan: The study consists of an introduction and three chapters, and a conclusion. The introduction: included the reasons for selecting the topic, the problems, the objectives, the previous studies, the methodology and the plan. The first chapter is entitled: (Al-Madina paper - descriptive study), and consists of the following detective: The first topic: Introduction to the study of Al-Madina paper. The second topic: Al Madina paper between naming and description. The third topic: Al-Madina paper between the definition of time and place. The fourth topic: the text of Al-Madina paper. The fifth topic: the scientific status of Al Madina paper. Chapter two: (Al-Madina paper and jurisprudence of citizenship), and consists of the following detective: The first topic: Introduction to understanding citizenship. The second topic: Public responsibility in the light of the paper. The third topic: Building the homeland in the light of the paper. The fourth topic: Citizens' rights and duties in the light of the paper. The fifth topic: The circles of citizenship in Islam. Chapter three: (Problems and suspicions about the paper citizenship), and The consists of the following detective: The first topic: The problem of the religious state. The second topic: The problem of denying the killing of the believer infidel. The third topic: The problem of denying the unbeliever's victory over the believer. The fourth topic: The problem of copying the paper with the provisions of the Sharia. The fifth topic: Other suspicions and problems about the paper. In conclusion: A statement of the most important findings, and the most important recommendations.
