المستخلص: عنوان البحث: عناية السنة النبوية بحقوق الإنسان الحمد لله والصلاة والسلام على رسول الله صلى الله عليه وسلم وبعد: أهمية البحث: تكمن أهمية هذا البحث في أنه يعالج قضية تعددت حولها وجهات النظر، وتنامي الجدل، وكثر فيها السجال الفكري، وتزايدت أعداد الجمعيات والمنظمات الحكومية وغير الحكومية، المنتصرة لقضايا حقوق الإنسان، وكثر التركيز عليها في وسائل الإعلام، التي لا يمكن إنكار ما لها من تأثير فعال، وأصبح المجتمع الدولي يوليها عناية خاصة، ولم يخل المجتمع العربي والإسلامي من تلك التأثيرات، مع ما تبع ذلك من موجات عارمة من التشكيك والافتراء على الإسلام والطعن فيه، سواء عن سوء قصد من أعدائه، أو جهل به من أبنائه، وتعددت المفاهيم المتناولة لهذه القضية بتعدد المرجعيات، مما يجعل قضايا حقوق الإنسان تتأرجح بين نوازع الفردية والاجتماعية، فكان من الضروري بيان رأي الإسلام من خلال نصوصه مع التركيز على الجانب الحديثي منها. سبب اختيار الموضوع: اخترت موضوع حقوق الإنسان لأهميته، ولكثرة الحديث عنه في هذه الآونة عبر الوسائل المختلفة، حتى صار هذا المصطلح على ألسنة الخاصة والعامة، والعجب أن البعض صار يؤصل لهذا المصطلح بميثاق الأمم المتحدة في منتصف القرن الماضي والمؤتمرات التي تلته، مع أننا نجد أن الإسلام بمبادئه الراسخة وقيمه العالية كان له السبق على غيره في إرساء مبادئ حقوق الإنسان بنظرة شمولية. أهداف البحث: يهدف هذا البحث إلى عدة أمور أراها مهمة منها: 1- جمع النصوص النبوية المتعلقة بموضوع حقوق الإنسان وتخريجها مع دراسة أسانيدها والحكم عليها، والتعليق على متونها بشيء من الإيجاز. 2- بيان أسبقية الإسلام على غيره من النظم والأيديولوجيات في قضية حقوق الإنسان. 3- بيان شمولية الإسلام ومعالجته لشتى القضايا التي تعن للإنسان في جميع الأزمنة وجميع الأمكنة. 4- التأكيد على أن الإسلام احترام الإنسان بصفة عامة، فهو مكرم بتكريم الله له، وكفل له جميع حقوقه وطالبه أن يؤدي ما عليه من واجبات، وأعطى له حق الحرية وجعل عبوديته لله وحده، وحفظ له نفسه وماله وعرضه، مع دحض الشبهات التي تقول إن المرأة مهضوم حقها في الإسلام، وأعطى له حق العمل والكسب، وحق الصحة والرفاهية، وحق التعلم، وحق التمتع بنظام اجتماعي.
