المستخلص: The performance guarantees(Final guarantee) plays a pivotal role in moving the internal and external trade and the fact that it guarantee the smooth implementation of contracts and commitments in the supply of goods and equipment, and as a first step provided by the contractors to ensure proper implementation of the undertakings in favor of public bodies, and the extreme importance that exempt them from the effects of monetary liability in terms of that guarantee the rights of both public entities contracting, Syrian and ensure banks. Our goal has discussed this concept to the study of the performance bond and its conditions and its corners and types of legal and positive to them. And then how we dealt with the issuance of this type of guarantees of various types and methods of abolition. Then we explained to pay bails good execution procedures. And then, we dealt with the role and importance of the performance guarantees in the trade through official production figures for banks operating in Syria during the period (2000-2015) of which has enabled us to make comparisons among themselves to determine the size of each bank in this matter, which in turn give us the findings of her the study, which was the most important significant decline in the proportion of performance guarantees to GDP As well as the sharp decline in the number of foreign banks that accept dealing with local banks, which are called (correspondent banks). Finally, Find concludes specific proposals aimed at activating the role of performance guarantees (Final guarantee) and increase its size.

تقوم كفالات حسن التنفيذ (النهائية) بدور هام وحيوي في تحريك المبادلات التجارية الداخلية والخارجية وذلك كونها الضمانة في حسن تنفيذ العقود والتعهدات وفي توريد السلع والمعدات، وكونها الخطوة الأولى التي يقدمها المتعهدون لضمان حسن تنفيذ التعهدات لصالح الجهات العامة، وللأهمية البالغة التي تعفيهم من آثار المسؤولية النقدية من حيث ضمان حقوق كل من الجهات العامة المتعاقدة، والمصارف السورية الكفيلة. وقد هدفنا من بحثنا هذا إلى دراسة مفهوم كفالة حسن التنفيذ وشروطها وأركانها وأنواعها والموجب القانوني لها. وأيضا كيفية إصدار هذا النوع من الكفالات بأنواعها المختلفة وطرق إلغائها. وبعد ذلك شرحنا إجراءات دفع كفالات حسن التنفيذ. ومن ثم تناولنا دور وأهمية كفالات حسن التنفيذ في المبادلات التجارية وذلك من خلال الأرقام والإحصاءات الرسمية للمصارف العاملة في سورية خلال الفترة (2000-2014) م التي مكنتنا من إجراء المقارنات فيما بينها لمعرفة حجم كل مصرف في هذا الأمر والتي بدورها تعطينا النتائج التي توصلت لها الدراسة والتي كان أهمها الانخفاض الكبير في نسبة كفالات حسن التنفيذ إلى الناتج المحلي الإجمالي، وكذلك الانخفاض الشديد في عدد المصارف الأجنبية التي تقبل التعامل مع المصارف المحلية والتي تسمى (المصارف المراسلة). وأخيراً يخلص البحث إلى مقترحات محددة تهدف إلى تفعيل دور كفالات حسن التنفيذ وزيادة حجمها.
