المستخلص: La liberté d’investissement est un principe consacré par la constitution Algérienne, puisqu’il est considéré comme le noyau fondamental du nouveau système économique que tente de suivre l’Algérie depuis quelque année: celui de l’économie du marché.
Hélas les derniers bouleversements dans le monde économique, en particulier la chute des prix du pétrole ont eu de lourdent répercussions notamment sur les pays dans l’économie dépend entièrement des hydrocarbures comme l’Algérie.
Cette dernière qui a essayé de faire face a la situation avec de multiple solutions, parmi lesquels la révision de sa politique de commerce extérieure avec l’imposition de certaines restrictions comme l’adoption du règlement des licences ;afin de mieux gérer et contrôler son marché et réduire la faramineuse facture d’importation, qui pèse de plus en plus lourd sur l’économie du pays ,tout en continuant de protéger la production nationale et encourager la promotion de l’exportation hors hydrocarbures.
Mais toutes ses nouvelles mesures posent toute fois le problème de la constitutionnalité des licences d’importation/exportation de marchandises face au principe de la liberté d’investissement.

The principle of freedom of investment is one of the most important principles enshrined in the Constitution of the Algerian legislature following Algeria's move to a new economic order based on the principles of a market economy. However, the economic conditions that Algeria is experiencing, particularly after the collapse of oil prices, made it necessary to review its policy towards the import and export process.
It adopted the licensing system as an administrative and regulatory measure aimed at reducing the import bill, protecting national production and promoting exports outside the fuel sector.
However, Algeria's adoption of a licensing system for the import or export of goods has raised many legal questions as to whether it would contradict the freedom of investment enshrined in the Constitution and the various investment laws.

يعتبر مبدأ حرية الاستثمار من أهم المبادئ التي كرسها المشرع الجزائري في الدستور بعد توجه الجزائر إلى نظام اقتصادي جديد يعتمد على مبادئ اقتصاد السوق، غير أن الظروف الاقتصادية التي تمر بها الجزائر خاصة بعد انهيار أسعار البترول حتم عليها مراجعة سياستها اتجاه عملية الاستيراد والتصدير فاعتمدت نظام الرخصة كإجراء إداري تنظيمي يهدف إلى الحد من فاتورة الاستيراد وحماية الإنتاج الوطني وترقية الصادرات خارج قطاع المحروقات، لكن اعتماد الجزائر نظام الرخصة لاستيراد البضائع أو تصديرها أثار الكثير من التساؤلات من الناحية القانونية فيما إذا كان سيتعارض وحرية الاستثمار التي كرسها المشرع الجزائري في الدستور ومختلف التشريعات المتعلقة بالاستثمار؟
