المستخلص: يعد احترام الواجبات من بين أهم الأسس التي يقوم عليها حسن سير المرفق الإستشفائي لذا يجب على الأطباء الذين يعهد إليهم مهمة السهر على حسن سير هذا المرفق الالتزام بما فرضه القانون من التزامات وواجبات، إلا أن الطبيب كغيره من البشر قد يرتكب أثناء القيام بمهنته جرائم، وحماية للمرضى فرض المشرع مسؤولية جزائية على الأطباء إذا ما ارتكبوا أي جريمة من الجرائم المنصوص عليها قانوناً، سواء كانت هذه الجريمة عمدية أو غير عمدية وسواء كانت تمس بالسلامة الجسدية للمريض أم لم تكن تمس بها، كما يلتزم المرفق الاستشفائي الذي يعمل به الطبيب بدفع التعويض للمريض إذا ما شكلت الجريمة خطأ مرفقي كذلك.

Respect for duties is one of the most important foundations of the proper functioning of the hospital facility. Therefore, doctors who are entrusted with the task of ensuring the proper functioning of this facility must comply with the obligations and duties imposed by law. However, a doctor, like other human beings, may commit crimes while carrying out his profession. The legislator imposed penal liability on doctors if they commit any of the crimes stipulated by law while protecting patients, whether this crime is intentional or unintentional and whether it affects the physical integrity of the patient or not. The hospital facility where the doctor works is obliged to pay compensation to the patient if the crime constitutes an error as well.

Le respect des devoirs est les plus importantes du bon fonctionnement de établissement hospitalier, donc doit à les médecins qui sont chargés d'assurer le bon fonctionnement de la mission de ce établissement, se conformer aux obligations et les droits imposées par la loi, Mais le médecin, comme les autres êtres humains ont commis des crimes tout en faisant sa profession, Et pour la protection des patients législateur 'imposer une responsabilité pénale aux médecins si elles ont commis l'un des crimes prévus par la loi, que ce soit le crime, intentional ou non et si elles affectent l'intégrité physique du patient ou ne sont pas qui les concernent, l’établissement hospitalier qui travaille le médecinil doit verser une indemnité au patient si le crime constituait une faute de service aussi.
