المستخلص: La création d’une Haut Instance indépendante de surveillance des élections en vertu de l'article 194 de la révision constitutionnel de 2016 ; est une étape importante pour entourer les opérations électorales le plus possible de la transparence et la probité, compte tenu de la composition de la Haut Instance, qui réunit de 205 magistrats, et de 205 compétences indépendantes choisies parmi la société civile.
Cependant, la question qui se pose est centrée autour des garanties nécessaires d’après les textes constitutionnelles etlégislatives relatives à la Haut Instance pour avoir la tâche de surveiller les élections en toute indépendance, et quelles sont les limites des prérogatives de la Haut Instance pour assurer la mise en oeuvre de surveillance des opérations électorales, comme une obligation constitutionnelle?


The establishment of the Independent High Electoral Monitoring Body under Article 194 of the 2016 Constitutional Amendment is a valuable step towards making the electoral processes as transparent and fair as possible. Given the composition of the supreme body, which brings together members of judges and independent competencies within civil society.
However, the question that arises revolves around the necessary guarantees provided by the Constitutional Founder and other legal texts relating to the Supreme Commission for its independent monitoring of the elections and To what extent is the authority of the Supreme Commission to monitor the implementation of the constitutional obligation to observe elections?

إن إحداث الهيئة العليا المستقلة لمراقبة الانتخابات بموجب المادة 194 من التعديل الدستوري لعام 2016 يشكل خطوة ثمينة في سبيل إحاطة العمليات الانتخابية بأكبر قدر ممكن من الشفافية والنزاهة، بالنظر لتركيبة الهيئة العليا التي تجمع بين الأعضاء القضاة، والكفاءات المستقلة من ضمن المجتمع المدني.
غير أن التساؤل الذي يطرح يتمحور حول الضمانات اللازمة التي أحاطها المؤسس الدستوري والنصوص القانونية الأخرى المتعلقة بالهيئة العليا لقيامها بمهمة مراقبة الانتخابات بكل استقلالية، وأي مدى تقف عنده صلاحيات الهيئة العليا في السهر على تنفيذ الالتزام الدستوري المتمثل في مراقبة الانتخابات؟
