المستخلص: la protection internationale des droits de l'homme est d'une grande importance ,ayant essentiellement l'objectif de protéger l'être humain et préserver sa dignité, en partant de la détermination de ses droits et développement des garanties en mesure de protéger ces droits et l'élaboration des différents mécanismes de contrôle, en vertu des accords internationaux, elle a contribué à la élaboration des règles juridiques obligeant les états à l'égard de la question des droits de l'homme.
Et si la protection internationale a contribué à améliorer des situations des droits de l'homme – particulièrement – dans des circonstances ordinaires qui succombent au principe de la légalité, comment sera la situation dans des circonstances exceptionnelles et inhabituelles en raison d'une menace ou d'un danger qui peut nuire à la sécurité de l'Etat et sa stabilité son 'intégrité territoriale.
En conséquence, l'objet de cet article est de mettre en évidence la notion de circonstances exceptionnelles et des contrôles, et leur impact sur la protection internationale des droits de l'homme.


International protection of human rights is of great importance. It aims at protecting human beings and preserving their dignity, building upon the definition of their rights and the establishment of safeguards to protect these rights. The establishment of various monitoring mechanisms, under international conventions, has contributed to the formation of legal norms binding on States concerning the cases of human rights.
While international protection has contributed to improving the human rights situation, particularly in normal circumstances characterized by the principle of legality, how can this be the case in exceptional and unusual circumstances, as a result of a threat or danger that may harm the security, stability and territorial integrity of the State?
Therefore, this article will focus on highlighting the concept of exceptional circumstances and their controls and impact on the international protection of human rights.

تكتسي الحماية الدولية لحقوق الإنسان أهمية بالغة، كونها تهدف في أساسها لحماية الإنسان وصون كرامته، انطلاقاً من تحديد حقوقه ووضع الضمانات الكفيلة بحماية هذه الحقوق؛ وإيجاد الآليات الرقابية المختلفة، بموجب اتفاقيات دولية، أسهمت في تشكيل قواعد قانونية ملزمة للدول تجاه قضايا حقوق الإنسان.
وإذا كانت الحماية الدولية قد ساهمت في تحسين أوضاع حقوق الإنسان – خصوصاً – في الظروف العادية التي تتسم بالخضوع لمبدأ المشروعية. فكيف يكون عليه الأمر في الظروف الاستثنائية غير المألوفة؛ كنتيجة لتهديد أو خطر قد يضر بأمن الدولة واستقرارها وسلامة ترابها.
وعليه فسيتم التركيز في هذا المقال على إبراز مفهوم الظروف الاستثنائية وضوابطها وأثرها على الحماية الدولية لحقوق الإنسان.
