المستخلص: Le pouvoir judiciaire algérien manque d’indépendance, malgré la disposition explicite de la constitution, et la loi fondamentale de la magistrature ne soutient pas cette indépendance, mais elle a plutôt soutenu la domination du pouvoir exécutif (le président de la république et le ministère de la justice) sur les pouvoirs du conseil supérieur de la magistrature. Ce qui affecte l’indépendance de la magistrature.

The Algerian Judiciary lacks the principle of independence, although this is explicitly stated in the Constitution. However, the Basic Law on the Judiciary has been promulgated to uphold the same principle through the dominance of the executive branch, the President of the Republic and the Ministry of Justice, over the powers of the Supreme Council of the Judiciary and its assortment. This affects the independence of the Judiciary. Moreover, the Algerian Constitution does not provide a fundamental guarantee of the independence of the Judiciary, which is the tenure principle of judges.

تفتقر السلطة القضائية في الجزائر إلى مبدأ الاستقلالية على الرغم من النص على ذلك صراحة في الدستور، غير أنه صدر القانون الأساسي للقضاء ليعمل على نفس مضمون هذا المبدأ من خلال هيمنة السلطة التنفيذية المتمثلة في رئيس الجمهورية ووزارة العدل على اختصاصات المجلس الأعلى للقضاء وتشكيلته، مما يمس باستقلالية السلطة القضائية، إضافة إلى أن الدستور الجزائري لم يأت بضمان أساسي من ضمانات استقلالية السلطة القضائية، والمتمثل في مبدأ عدم قابلية القضاة للعزل.
