أدركت العديد من الدول المتقدمة خطورة جريمة الإتلاف المعلوماتي وسنت القوانين التي تتصدى لهذه الظاهرة الإجرامية وتحد من مخاطرها واما العراق وبقية الدول العربية حاولت استيعاب تلك الجرائم من خلال سن تشريعات خاصة بها إلا إنها محاولات خجولة لا ترقى إلى خطورة تلك الجرائم وأثاراها الضارة على المجتمع. كما أن دخول الإنترنت ووسائل الاتصال التقنية حديثا إلى العراق وتأخر مشرعنا العراقي عن مواكبة هذا التطور الذي طرء على المجتمع فضلا عن قلة الأبحاث التي تتحدث عن هذه الجريمة وندرتها بين الدراسات القانونية العراقية لذا جات هذه الدراسة لتسلط الضوء على موضوع مهم وكبير له أثار خطيرة على المجتمع ومصالحة العامة والخاصة وهو أثار المسؤولية الجزائية عن جريمة الإتلاف المعلوماتي وسبل مكافحتها باعتباره سلوك أجرامي يستهدف الجاني من وراءه تدمير وأتلاف وتخريب الأجهزة التقنية المعلوماتية الحديثة ومن ابرزها الحاسب الآلي وما يتضمنه من معلومات تهم حياة الأفراد والمؤسسات العامة والخاصة ومن خلال طرق مختلفة تتطور بتطور تلك الأجهزة الإلكترونية ولذلك حاولت هذه الدراسة تسليط الضوء على جانب مهم يتعلق بالمسؤولية الجزائية المترتبة على هذه الجريمة وسبل مكافحتها على المستويين الدولي والوطني من خلال التطرق للجهود الدولية التي بذلت لمكافحة هذه الجريحة وبما يساعد المشرع العراقي للوقوف على كافة جوانبها والحد من أثارها وردع مرتكبيها.

The entry of the Internet and the means of modern technical communication to Iraq and the delay of our Iraqi legislator to keep pace with this development that took place in the community as well as the lack of research that talk about this crime and rare among the Iraqi legal studies so this study to highlight the subject Is a criminal responsibility for the crime of information and the means of combating it as a criminal behavior targeting the culprit behind the destruction, destruction and destruction of modem information technology. The most important of which is the computer and the information that includes the lives of individuals and public and private institutions and through the methods, the study attempts to shed light on an important aspect related to the criminal responsibility of this crime and ways of combating it at the international and national levels by addressing international efforts.
