المستخلص: الحمد لله رب العالمين، والصلاة والسلام على سيدنا محمد وعلى آله وصحبه أجمعين.
وبعد: فإن الحفاظ على مقاصد الشريعة الإسلامية من أهم الواجبات الدينيّة والدنيوية التي أناط الشارعُ لأولياء الأمور وذوي الاختصاصات أن يحافظوا عليها ويُعملوا كلَّ وسيلةٍ تؤدي إلى إثرائها والذوْدِ عنها.
وبدراسةِ موجزَةٍ لنظرية "اعتبار المآلات" في الشريعة الإسلامية، وتنزيل مظانِّها على ظاهرة "الهجرة غير الشريعة": توصلَ الباحث - وبما لا يدعُ مجالاً للشك - إلى أن الهجرة غير الشرعيةِ قد استشرى ضررُها في مجتمعنا الحبيب، وما يؤول إليه أمرُها من فسادٍ وإهدارٍ للقيم الأخلاقية والاجتماعية فضلاً عن العبث بأمن الدولةِ ومقدَّراتها -كلُّ ذلك- خطرُه جسيم، وشرُّه مستطير.
وعليه: فإن المآلات التي تفضي إليها هذه الظاهرة مآلاتٌ فاسدةٌ تخرُم مقاصد التشريع ولا تتفقُ مع مبادئه وأحكامه، فلا مناصَ من حمايتها بتشريعاتٍ قانونيةٍ تحقق هذه الأفضليّة التي تفضي إلى تحقيق مقاصد التشريع الإسلامي.


Praise be to the Lord of all worlds. Prayers and peace be upon our Prophet, Muhammad, his family, and all of his companions.
The preservation of the maqasid al-Shariah (objectives of Islamic law) is one of the most important religious and worldly duties that the legislator entrusts to people of authority and specialists to preserve them and work every means that leads to enriching and defending them.
In a brief study of the theory of Maalat (consequences of an action) in the Islamic Shariah, and lowering its habitat on the phenomenon of “illegal migration”, the researcher concluded - beyond any doubt - that illegal migration has spread its harm in our beloved society, and the corruption and waste of moral values as well as tampering with the security of the state and its capabilities, -all that- is a grave danger and widespread evil.
Accordingly, the consequences of the action of this phenomenon are corrupt consequences that violate the purposes of the legislation and are not in conformity with its principles and provisions. It is imperative to protect them by legal legislation that achieves this preference, which leads to the achievement of the objective of Islamic legislation.
