|f Through the resolution on the responsibility of the real estate governor, the Algerian legislator wanted him to have keen vigilance and vision in carrying out the tasks entrusted to him in view of the possible negative repercussions on trust in real estate ownership and the instability of transactions related to it, which supports the principles of absolute limitation and evidentiary force. In order to protect this, the Algerian legislator has recognized the responsibility of the State as a public asset for the associated errors committed by the real estate governor, in accordance with article 23 of Ordinance 74-75, which includes the preparation of the general land survey and the establishment of the Cadastre, which stipulated that the State shall be liable for errors that are harmful to others committed by the real estate governor while exercising his duties.\nThis abstract translated by Dar AlMandumah Inc. 2021

|a أراد المشرع الجزائري من خلال تقرير مسؤولية المحافظ العقاري أن يتطلب منه اليقظة الشديدة والروية في مباشرة المهام الموكلة إليه، نظرا لما قد يكون للأخطاء التي يقع فيها من انعكاسات سلبية على الثقة بالملكية العقارية، وعدم استقرار المعاملات المتعلقة بها، الأمر الذي يدعم مبدئي القيد المطلق والقوة الثبوتية، وحماية لذلك أقر المشرع الجزائري مسؤولية الدولة كأصل عام عن الأخطاء المرفقية التي يرتكبها المحافظ العقاري، ذلك بموجب المادة 23 من الأمر 74- 75 المتضمن إعداد مسح الأراضي العام وتأسيس السجل العقاري والتي نصت على أن الدولة تكون مسؤولة بسبب الأخطاء المضرة بالغير والتي يرتكبها المحافظ العقاري أثناء ممارسة مهامه.

|d Le législateur algérien, dans un rapport sur la responsabilité du gouverneur de l'immobilier, a souhaité qu'il soit très vigilant afin de mener à bien les tâches qui lui étaient confiées, sachant que les erreurs commises pourraient avoir des répercussions négatives sur la confiance en la propriété et l'instabilité des transactions qui s'y rapportent. Le législateur algérien a reconnu la responsabilité de l'État en tant que bien public pour les erreurs d'annexion commises par le gouverneur de l'immobilier en vertu de l'article 23 de l'ordonnance n o 74-75, qui prévoyait la préparation d'un arpentage public et l'établissement d'un registre foncier, qui stipulait que l'État était responsable des erreurs.
