تعتبر قضية سلطة ولي الأمر في تقييد المباح ورفع الخلاف من القضايا ذات الأهمية الخاصة؛ وذلك لتعليقها بولي الأمر الذي أمر الله عز وجل بطاعته بعد طاعة الله تعالى وطاعة رسوله صلى الله عليه وسلم، ولما يترتب على طاعة ولي الأمر من استقرار المجتمع وانتظام أحواله وأموره. مع الأخذ في الاعتبار أن لتلك الطاعة حدودا وضوابط. وقد تناول البحث تحديد المراد بولي الأمر وسلطته في تقييد المباح ورفع الخلاف، وعرض لآراء الفقهاء في حكم تقييد ولي الأمر للمباح مناقشا ومرجحا، ومبينا الضوابط اللازمة لذلك. كما عرض لآراء الفقهاء في حكم رفع ولي الأمر للخلاف مناقشا ومرجحا، ومبينا الضوابط كذلك. ثم عرض لنموذج تطبيقي لسلطة ولي الأمر في تقييد المباح ورفع الخلاف من خلال حكم تقنين الفقه الإسلامي. وانتهى لجملة من النتائج.
