المستخلص: يمثل السكن غير القانوني مكونا أساسيا للمجال الحضري بتونس الكبرى. وقد نمت منذ سنوات 1970 ظاهرة التقسيم غير القانوني للأراضي والبناء بدون ترخيص خاصة بأطراف العاصمة. نسلط الضوء في هذا العمل، بالاعتماد على حالة بلدية رواد -إحدى البلديات شبه الحضرية لتونس الكبرى-على طبيعة تعاطي السلطة البلدية مع انتشار السكن غير القانوني، مبرزين عجزها على التحكم في تطوره بالرغم من المحاولات للحد منه، استنادا إلى عدة آليات لمراقبة تطور الظاهرة وتطبيق القانون على المخالفين لتراتيب التعمير الجاري بها العمل وقانون حماية الأراضي الفلاحية.

Non-regulatory habitat is an essential component of the urban area of Greater Tunis. Since the 1970s the phenomenon of illegal subdivisions and non-regulatory structures have been rising to spread spatially especially in the outskirts of the capital Tunis. Referring to the case of the suburban municipality of Raoued, the present work aims to shed some light on the relationship between the proliferation of non-regulatory habitat and local power. It tries to demonstrate the inability of municipal power to manage the phenomenon of the proliferation of non-regulatory structures, and although it tried to limit the damage through the implementation of some mechanisms for monitoring, controlling and penalizing lawbreakers of existing, in the fields of urban planning and protection of natural resources including agricultural land.

L’habitat non réglementaire forme une composante essentielle de l’espace urbanisé du Grand Tunis. Depuis les années 1970 le phénomène des lotissements illicites et les constructions non réglementaires n’ont cessé d’augmenter et de s’étaler spatialement notamment dans la périphérie de la capitale Tunis. En se référant au cas de la commune périurbaine de Raoued, Le présent travail a pour objectif d’analyser la relation entre la prolifération de l’habitat non réglementaire et le pouvoir local. Ce travail essaie de démontrer l’incapacité du pouvoir municipal à gérer le phénomène de la prolifération des constructions non réglementaires, malgré la mise en œuvre de mécanismes de surveillance, de contrôle et de pénalisation des violeurs de la règlementation en vigueur dans les domaines de l’urbanisme et de la sauvegarde des ressources naturelles, notamment les terres agricoles.
