|d La question de l'ijtihad dans la pensée islamique est encore une réalité qui doit être étudiée en profondeur pour éliminer plusieurs ambiguïtés. À ce jour, il existe différents points de vue sur la fermeture de la porte de l'ijtihad au quatrième siècle AH et si des conditions étaient disponibles pour examiner les décisions jurisprudentielles ou non. Si nous abordons la question de la science de la jurisprudence, le sujet devient plus complexe sous prétexte d'achèvement, car certains croient qu'il n'y a pas de place pour le renouvellement parce que la plupart de ses règles de vocabulaire et de langue ne sont pas recherchées Et nous avons choisi trois sujets pour prouver la possibilité de renouvellement de la jurisprudence 1- Adoption des coutumes arabes comme cadre culturel pour comprendre les textes juridiques en Islam 2- Activer les objectifs de la Shari'a pour quelle devienne une source de déduction des Dispositions relatives à la charia . 3- L'établissement d'une nouvelle source de législation visant à supprimer les bases linguistiques afin de favoriser la raison.

|b The question of ijtihad in Islamic thought is still a reality that needs to be studied in depth to eliminate several ambiguities. To date, there are different views on the closure of the ijtihad gate in the fourth century AH and if conditions were available to review jurisprudential decisions or not If we turn to the science of jurisprudence, the subject becomes more complex under the pretext of completion, because some believe there is no room for renewal because most of its rules of vocabulary and language are not searched And we chose three subjects to prove the possibility of renewing the jurisprudence: 1- Adoption of Arab customs as a cultural framework for understanding legal texts in Islam. 2- Activate the goals of the Shari'a for what becomes a source of deduction of the Shariah Provisions. 3- The establishment of a new source of legislation to remove language bases in order to promote reason.

|a لا يزال موضوع الاجتهاد في الفكر الإسلامي إلى حد الآن يشكل واقعا يحتاج إلى دراسة معمقة تزيح الكثير من الظلال عنه. فإلى يومنا هذا يكثر الجدل حول غلق باب الاجتهاد في القرن الرابع هجري من عدمه. وهل توافرت الشروط و الظروف الضروريتان لفتحه ثانية أم أنه ما ترك الأوائل للمتأخرين من شيء يستوجب بذل الجهد فيه. فإذا ولجنا لمسألة علم أصول الفقه فإن الموضوع يزداد تعقيدا بدعوى اكتماله، إذ يرى البعض أن لا مجال للتجديد فيه لأن جل مفرداته قواعد لغوية غير قابلة للبحث والاجتهاد. وقد وقع اختيارنا على ثلاثة مواضيع نثبت من خلالها إمكانية التجديد في أصول الفقه وهي: - اعتماد العادات العربية كإطار ثقافي لفهم النصوص الشرعية في الإسلام. - تفعيل مقاصد الشريعة لتصير بعد ذلك مصدرا من مصادر استنباط الأحكام الشرعية. - التأسيس لمصدر جديد من مصادر التشريع يمكن تسميته "إرشاد الشرع إلى الأحكام بالأحكام" أو "إتمام الأحكام بالأحكام أخرج فيه عن القواعد اللغوية إلى إعمال العقل والاستقصاء.
