المستخلص: لقيام علاقة العمل الفردية بين صاحب العمل والعامل وانعقاد عقد العمل يستوجب توافر عنصر الأجر لأنه أحد أركان عقد العمل الفردي، وبدون الأجر يصبح العمل تطوعياً ولا تقوم علاقة العمل، ويحظى الأجر بحماية قانونية من الدائنين، كما أن عدم المطالبة به يؤدي إلى سقوطه طبقاً لأحكام القانون المدني.

For the establishment of an individual working relationship between the employer and the worker and the holding of the employment contract, it is necessary to carry the wage component because it is one of the pillars of the individual employment contract. without pay, the work becomes voluntary and the work relationship is not established .the wage is legally protected from the creditors .and the dact of not claiming the salary entails its fall in accordance with the provisions of the civil code.

Pour l’établissement d’une relation de travail individuelle entre l’employeur et le travailleur et pour conserver le contrat de travail, il est nécessaire de porter la composante salariale car il s’agit d’un des piliers du contrat de travail individuel .Sans rémunération, le travail devient bénévole et la relation de travail n’est pas établie. Le salaire est légalement protégé contre les créanciers. Et le faite de ne pas réclamer le salaire entraîne sa chute conformément aux disposition du code civil.
