المستخلص: يتم التفريق بين المرافق العامة القابلة للتفويض وغير القابلة عن طريق المنع المنصوص عليه في قوانين الدولة (الدستور، والتشريعات)، كما قد تحتمه طبيعة المرفق وهنا نميز بين المرافق السيادية وأخرى الغير سيادية. وما يلاحظ أن هناك عدة مبررات قد تدفع السلطة المسؤولة لتفويض المرفق المحلي، وتملك هذه السلطة جملة من الصلاحيات من أجل انجاح عملية التفويض، ولعل أبرزها إصدار القرار الأولي للتفويض المرفق العام، والذي يتخذ بناء على تقرير معلل تبين فيه السلطة المفوضة أن التفويض هو أحسن طريقة من حيث المزايا مقارنة مع أساليب التسيير الأخرى، ويرسل هذا التقرير إلى السلطة الوصائية. كما تنشأ لجان ثلاثة على مستوى كل من البلدية والولاية تكلف بوظائف تعمل تحت إشراف السلطة المفوضة ضمانا لإنجاح عملية تفويض المرفق العام المحلي.

Une distinction est faite entre les services publics qui peuvent être délégués et ne sont pas soumis à l'interdiction stipulée dans les lois de l'État (constitution et législation), comme le requiert la nature de la facilité, et nous distinguons ici entre les facilités souveraines et non souveraines.
