|a لم يكن لأبي عوانة-رحمه الله تعالى-كتاب خاص يجمع فقهه، وإنما كانت آراؤه واختياراته الفقهية مبثوثة في عناوين أبواب كتابه "المسند الصحيح المخرج على صحيح مسلم"، فكان من الأهمية أن تجمع تلك الأبواب وتدرس؛ ليسهل على طلاب العلم والباحثين الرجوع إليها. هدف إلى إبراز فقه الإمام أبي عوانة-رحمه الله- في مسائل الأطعمة من خلال كتابه المستخرج. ودراسة اختيارات الإمام أبي عوانة رحمه الله-دراسة فقهية في باب الأطعمة. وبيان المسائل التي وافق أو خالف فيها الإمام أبو عوانة-رحمه الله-مذهب الشافعية من خلال الأبواب المدروسة. والإشارة لأقوال المذاهب الفقهية (الحنفية، المالكية، الشافعية، الحنابلة) عند دراسة مسائل الإمام-رحمه الله. تم استخدام المنهج الاستقرائي الاستنباطي. أهم نتائج البحث: أولا: اسمه يعقوب بن إسحاق بن إبراهيم بن يزيد النيسابوري ثم الإسفرايينى، وكنيته أبو عوانة، طاف-رحمه الله-الكثير من البلدان من أجل طلب العلم والسعي له، توفي سنة 316ه، فرحمه الله رحمة واسعة. ثانيا: يتصل فقه الإمام أبي عوانة-رحمه الله- بفقه الإمام الشافعي، ويعتبر - رحمه الله-إماما عالما فقيها فذا، من المجتهدين غير المتقيدين بمذهبه، فله مسائل خالف فيها المذهب الشافعي. ثالثا: دقة الإمام أبي عوانة-رحمه الله-في تبويبه للمسائل دليل على سعة علمه وفقهه. رابعا: أن المسائل التي وافق فيها أبو عوانة-رحمه الله- مذهب الشافعية في هذا البحث سبع مسائل، والتي خالف فيها- رحمه الله-مذهب الشافعية مسألة واحدة.

|b Abu 'Awanah (may Allaah have mercy on him) did not have a special book that contains his jurisprudence. However, his views and doctrinal choices were reported in the titles of the chapters of his book, "Musnad al-Saheeh, extracted on Sahih Muslim". Therefore, it was important to gather and combine these chapters as well as study it, to make an easy access to these chapters by students and researchers. Research goals: To reveal the jurisprudence of Imam Abu Awanah - may Allah have mercy on him – regards to food via his extracted book. To study the choices of Imam Abu Awanah - may Allah have mercy on him – as a Juristic study of the chapters of food. To clarify the issues that Imam Abu Awanah - may Allah have mercy on him - agreed or disagreed with the doctrine of Shaafa'i in the chapters of food. To show the sayings of the doctrines of jurisprudence (Hanafi, Maliki, Shafi'i, Hanbali) along with the Imam Abu Awanah issues. Research Methodology: The inductive deductive method was used. The most important results of the research: Firstly: His name is Yaqoub ibn Ishaaq ibn Ibrahim ibn Yazid al-Nisabouri al- Isfariyani, and his nickname is Abu 'Uwanah. He traveled – may Allah have mercy on him - to many countries in order to seek knowledge and strive for it. He died in 316 H .May Allah have mercy on him. Secondly: the jurisprudence of Imam Abu 'Awanah - may Allah have mercy on him - is related to the jurisprudence of Imam Al-Shafi'i - may Allah have mercy on him - , and he is considered - may Allah have mercy on him as a scholar imam. He is very intelligent and one of the diligent scholar who do not adhere to his doctrine. He had some issues where he contradicted with the Shafi'i doctrine. Thirdly: The accuracy of Imam Abu 'Awana - may Allah have mercy on him - in his classification of the issues is clear evidence of his knowledge and jurisprudence. Fourthly: The issues in which Abu 'Awana - may Allah have mercy on him – agreed with the doctrine of the Shaafa'is are in (seven) issues from chapter the description of throwing the nuclei to the end of food book. However, the issues in which Abu 'Awana – may Allah have mercy on him – disagreed with the doctrine of the Shaafa'is are in (one) issues.
