For a long time, the subject of human rights has been the most important subject of international conventions and conventions, in an effort by the international community to improve this essential element in ensuring peoples' stability and security as it was necessary to devote all legal means and mechanisms in order to guarantee and preserve these rights. The right of the human to have access to an equitable justice has been an important point in the total of these agreements, so the provision came to the most important features of a fair judiciary and the guarantees for the emergence of an independent judiciary that would achieve justice and equality by applying the law and submitting to it, and then achieving the rule of law by adopting these general principles within the internal laws of the member states of those international forums, and with the difference in the internal laws and the difference in the legal degree of international agreements, constitutions remained the supreme laws that could not be violated by the provisions of the agreement and which are the other source of basic rights and public freedoms that must be respected in order to reach the guarantee of justice as a feature of democracy that states ostensibly seek to achieve. This abstract translated by Dar AlMandumah Inc. 2020 طالما كان موضوع حقوق الإنسان عبر أزمنة مختلفة يشكل أهم المحاور ضمن المواثيق والاتفاقيات الدولية، سعيا من المجتمع الدولي للارتقاء بهذا العنصر الأساسي في ضمان استقرار وأمن الشعوب، حيث كان ضروريا تكريس كل الوسائل والآليات القانونية من أجل ضمان هذه الحقوق والمحافظة عليها، وقد شكل حق الانسان في اللجوء إلى قضاء عادل نقطة هامة في مجموع تلك الاتفاقيات فجاء النص على أهم معالم القضاء العادل وضمانات نشأة سلطة قضائية مستقلة من شأنها تحقيق العدل والمساواة بتطبيق القانون والخضوع إليه، ومن ثم تحقيق دولة القانون من خلال الأخذ بتلك المبادئ العامة ضمن القوانين الداخلية للدول الأعضاء في تلك المحافل الدولية، ومع اختلاف القوانين الداخلية وتباين الدرجة القانونية للاتفاقيات الدولية، ظلت الدساتير تشكل أسمى القوانين التي لا يمكن أن تخالفها بنود الاتفاقية والتي هي الأخرى تعد منبع الحقوق الأساسية والحريات العامة الواجب احترامها من أجل الوصول إلى ضمان العدل كصفة لصيقة بالديمقراطية التي تسعى الدول ظاهريا لتحقيقها. La question des droits de l’homme à différentes époques a été le sujet le plus important des conventions internationales et la communauté internationale s’est efforcée de promouvoir cet élément fondamental pour assurer la stabilité et la sécurité des peuples il était nécessaire de consacrer tous les moyens et mécanismes juridiques pour garantir et préserver ces droits. Les droits de l'homme de recourir à la justice ne sont qu'un élément important du total de ces accords. Le texte sur les caractéristiques les plus importantes du système judiciaire juste garantit la mise en place d'un système judiciaire indépendant qui garantira la justice et l'égalité en appliquant la loi et en la soumettant, puis en respectant la règle de droit en appliquant ces principes généraux dans les lois. La Constitution reste la loi suprême qui ne peut être violée par les dispositions de la Convention, qui est également la source des droits fondamentaux et des libertés publiques qui doivent être respectés afin de réaliser la garantie de la justice en tant que droit d’association. Démocratie que les pays cherchent ostensiblement à réaliser. |
