المستخلص: هدفت هذه الدراسة إلى تحديد الطبيعة القانونية للخصومة القضائية وفقاً لقانون أصول المحاكمات المدنية الأردني رقم (24) لسنة ١٩٨٨ وتعديلاته لسنة ٢٠١٧، من خلال تحديد مفهوم الخصومة القضائية، وتحديد شروط قبول دعوى الخصومة القضائية، والتطرق إلى أسباب وقف الخصومة القضائية، إضافة إلى تحديد الطبيعة القانونية للدفوع الشكلية والدفوع الموضوعية التي حددها القانون فيما يتعلق بالخصومة القضائية، والآثار المترتبة على قبول الدفوع بالنسبة لطرفي الدعوى المدنية. وقد اتبع البحث المنهج الوصفي، للتوصل إلى معرفة دقيقة وتفصيلية عن التنظيم القانوني لموضوع الدفوع في الخصومة القضائية في عدد من التشريعات الوطنية، لتحقيق فهم أفضل لها وتحليلها. وقد تبين في نهاية الدراسة أن الخصومة القضائية هي حالة قانونية ناشئة عن مباشرة الدعوى، ترتب علاقة قانونية بين الخصوم، كما إن شروط دعوى الخصومة القضائية إما أن تكون موضوعية واجبة التوفر في الدعوى، منها ما يتعلق بالأطراف، كشرط الصفة والمصلحة، ومنها ما هو مرتبط بموضوع الدعوى كالإذن وعدم سبق الفصل في الدعوى، وإما أن تكون شروط شكلية خاصة ببعض الدعاوى دون البعض الآخر. وقد قدمت الدراسة عدداً من التوصيات من أبرزها قيام المشرع الأردني بتعديل نص المادة (١٢٣) من قانون أصول المحاكمات المدنية، لتقصير مدة الوقف الاتفاقي لتكون ثلاثة أشهر، أو إضافة نص يجيز للمحكمة تقدير مدة الوقف الاتفاقي بحسب كل سبب على حدا. وأن يقوم المشرع الأردني بتحديد موعداً للسير في اجراءات الدعوى بعد زوال سبب الوقف القضائي، وهذا من شأنه أن يحفز أطراف الخصومة على مواصلة الدعوى وعدم المماطلة تحقيقاً لمبدأ العدالة الناجزة. كذلك الاقتراح على المشرع الأردني بتعديل نص المادة (١٢٥) من قانون أصول المحاكمات المدنية ليتضمن السماح بالرجوع إلى بعض الإجراءات السابقة التي تمت قبل سقوط الدعوى والاستعانة بها أثناء إقامة دعوى جديدة، وذلك لأنها تتعلق بالحق الموضوعي ذاته، وبالتالي ما انطبق من إجراءات سابقة ينطبق في الدعوى الجديدة، وهذا من شأنه تعزيز مبدأ العدالة الناجزة واختصار الوقت والإجراءات.

The purpose of this study is to determine the legal nature of judicial litigation in accordance with the Jordanian Civil Procedure Law No. (24) of 1988 and its amendments in 2017, by defining the concept of judicial litigation, determining the conditions for accepting litigation, and addressing the reasons for the cessation of litigation. The legal defenses of substantive and substantive defenses established by law with respect to judicial litigation, and the implications of acceptance of defenses for the parties to a civil action. The research followed the descriptive approach, in order to obtain accurate and detailed knowledge about the legal organization of the subject of defenses in judicial litigation in a number of national legislation, to achieve a better understanding and analysis. It was found at the end of the study that the legal litigation is a legal case arising from the initiation of the lawsuit, which establishes a legal relationship between the litigants, and that the terms of the litigation are either substantive and must be available in the lawsuit, including with regard to the parties, as a condition of interest and interest, including what is related With regard to the subject of the lawsuit, such as permission and non-adjudication of the case, or to be formal requirements for some cases without others. The study made a number of recommendations, most notably the Jordanian legislator amending the text of Article (123) of the Code of Civil Procedure to shorten the period of the suspension to three months, or add a text that allows the court to estimate the duration of the suspension according to each reason. And that the Jordanian lawmaker set a date to proceed with the proceedings after the removal of the reason for the suspension, which would motivate the parties to the litigation to continue the proceedings and not to delay to achieve the principle of completed justice. Moreover, the Jordanian legislator should amend the text of Article (125) of the Code of Civil Procedure to include reference to some of the previous procedures that took place before the lawsuit was dropped and used during the filing of a new case, as it relates to the same substantive right and therefore the previous procedures that apply in The new lawsuit, this will strengthen the principle of completed justice and shorten the time and procedures.
