يعد عيب الشكل سبباً من أسباب أوجه إلغاء القرار الإداري. ويقصد بهذا العيب عدم التزام الجهات الإدارية بالقواعد الشكلية التي أوجبها المشرع في إصدار القرارات الإدارية. ويقصد بعيب الشكل، مخالفة الإدارة للقواعد الشكلية التي أوجبتها القوانين والأنظمة للمظهر الخارجى للعمل الإداري، وللإجراءات الواجب اتباعها في إصداره. أو إهمال أو عدم صحة الإجراءات الشكلية الواجب اتباعها في العمل الإداري. تهدف قواعد الشكل إلى حماية المصلحة العامة ومصلحة الأفراد على حد سواء. لأن عدم مراعاة تلك المصالح فيه إخلال بالضمانات المقررة للإدارة الأفراد. ولقد تبنت محكمة العدل العليا الأردنية كافة المعايير التي طورها الفقه القانوني للتمييز بين الشكليات الجوهرية والشكليات الثانوية. وقد اعتبرت المحكمة أن مخالفة قواعد الشكل مخالفة جسيمة لا تؤدي فقط إلى إلغاء القرار الإداري وإنما إلى تقرير انعدامه.
Formality Defect is regarded as one of the reasons for rescinding administrative decisions. It denotes the noncompliance of the administrative authorities with the procedural formalities forced by the legislature in delivering its administrative decisions. Formality Defect refers to the misapplication of the administration to the formal procedures mandated by law and regulations to the apparent administrative actions and to the procedures that must be followed in issuing that law, or ignoring or voiding the formal procedures that have to be adhered to in the administrative work. Formality rules aim to protect public as well as individual interests, and therfore failure to observe these interests will breach the specified undertakings of the administrations and the individuals. The High Court of Justice has adopted all criteria concerning the distinction between substantial and unsubstantial defects. The court decided that the substantial defect makes the decision null and not only cancelled. Importance of formality rules lies in the administrative observance of formalities as it originate from a law or a procedure (regulation), the general principals of the law, the judicial principals or from the administrative norms.
