هناك أحاديث يحتج بها الفقهاء والأصوليون، وتبنى عليها القواعد المهمة، تحتاج إلى بحث وتدقيق وحكم عليها، إذ ثبوتها يعنى الاطمئنان إلى العمل بها. ومن الأحاديث التي اشتهرت وانتشرت، وملأت بطون كتب السنة، والفقه، والأصول، والتفسير، حديث معاذ بن جبل رضي الله عنه في الاجتهاد، تصدر به أبواب الاجتهاد. وقد اختلف العلماء فيه من حيث القبول والرد، فقبله جماعة من العلماء، واستدلوا به، ورده أخرون وحكموا عليه بالضعف، بل والضعف الشديد. وكان لكل واحد من هؤلاء حجته ودليله، وهو أمر يحتاج إلى بحث وتدقيق، عند الحكم على هذا الحديث، كل هذا دفعني إلى البحث والتنقيب، وجمع أقوال العلماء حتى أصل إلى الصواب في الحكم على الرواية. والهدف من البحث: التعرف على نصوص الرواية وتخريجها، وذكر الروايات الأخرى لحديث معاذ، والوقوف على أقوال المصححين والمضعفين للرواية، وبيان أدلتهم، وذكر الراجح عند الحكم على الرواية، والوقوف على معنى الحديث. ومنهج البحث استنباطي حيث أسوق الأدلة وكلام العلماء، ثم استنبط الحكم النهائي. وهذه أهم النتائج: أن الرواية مشهورة، وأن من حكم على الرواية بالصحة معظمهم من الفقهاء والمتأخرين، ومن ضعف الرواية جلهم من المحدثين وأن الراجح ضعف الرواية نظرا لاضطرابها، وإرسالها، وجهالة بعض رجالها. ومن التوصيات: الاعتناء بتخريج الأحاديث المشتهرة، والاعتناء بدراسة أحاديث الأحكام، وخاصة التي تبنى عليها القواعد.
