يدور موضوع هذا البحث حول أحكام توزيع الأموال قبل الموت، وهو دراسة فقهية مقارنة وهذا الموضوع من الموضوعات ذات العلاقة الوثيقة في حياتنا. فقد بين القرآن الكريم أحكام التركات والأموال والأعيان التي يتركها الميت، وبين نصيب الورثة، وأعطى كل ذي حق حقه بنظام دقيق وعادل تجلت فيه الحكمة الربانية، ولم يترك الوحي مجالا للاجتهاد في أحكام التركات؛ لأن النفوس مجبولة على حب المال. ولكن الناس بطبعهم وحبهم للمال وحبهم للأبناء دفع الكثيرين منهم استجابة لميولهم وعواطفهم القلبية إلى توزيع أموالهم قبل الموت خصوصا إذا أحسوا بدنو الأجل، وهذا أدى إلى الوقوع في مخالفات شرعية صريحة، وإضرارا للورثة، وخلافات وخصومات ضارة بالحياة الاجتماعية بين المسلمين. ويعالج البحث الأخطاء الشرعية التي يرتكبها بعض المسلمين في وقتنا الحاضر، ومسائل مشابهه كثيرة تتعلق بتوزيع الأموال والأعطيات مثل البيع الصوري للأعيان من قبل الآباء للأبناء واشمل البحث على بيان أراء الفقهاء والمذاهب في هذه المسائل وإبراز الأدلة والحجج والبراهين في جميع ما ذهبوا إليه، مبينا القول الراجح فيما أوردوه من أقوال.
The theme of this study revolves around the provisions of the distribution of funds prior to death, and represents a study of Islamic jurisprudence in comparison with the Jordanian Personal Statutory Law, since this subject is a relevant issue in our lives. The Qur’an has revealed the provisions of inheritance, money, and objects that the deceased leaves, and also explained the share of heirs, giving everyone who is entitled a share their entitlement, through an accurate and fair system in which Allah’s wisdom was revealed. It did not leave room for discretion in the rulings of inheritance, since human beings are naturally dispositioned to love money. Many people in response to their tendencies and profound feelings towards their money and children distribute their money before death, especially when they feel their life is coming to an end. This leads to explicit violations regarding the legitimacy and rights of heirs, further leading to differences and prejudices which are harmful to the relationships between Muslims. This study is a modest attempt to address the breaking of Islamic Law committed by some Muslims today. This study discusses these rulings after examining the views of scholars and the schools of jurisprudence on these issues, providing clear evidence and arguments regarding all of the opinions, and tries to identify the strongest opinion.
