المستخلص: تمتاز الأحكام القضائية، لا شك، بلغة خاصة تميزها من غيرها من الخطابات. وهذه اللغة مرهونة بعوامل السياق المهني وطبيعة المتعاملين بهذه الخطابات. ومن جهة أخرى، تمتاز هذه الخطابات بمنطق مغاير للخطابات الحجاجية الأخرى (السياسية، الدعائية، التسويقية،...)، إن على صعيد الأدوات، وإن على صعيد التخطيط. توصف لغة القانون بأنها لغة الإقناع، لأنها تخاطب العقل بالمنطق، وتقوم على الحجة. والحكم القضائي هو عنوان الحقيقة التي يراها القاضي بحسب ما اطمأنت إليه نفسه، بعد حجاج داخلي اعتلج في نفس القاضي حتى اقتنع هو نفسه، والخطاب الذي سيتلفظ به يجب أن يحمل آثار شيء من منطق حجاجي.

Court decrees are significantly peculiar due to the unique nature of the juridical system and its personnel. Such decrees are governed by logic and the use of certain terms and linguistic patterns which are completely different than those of debates and other speeches which are used for political campaigns, advertisements, marketing and other communication purposes. The legal language is a language of conviction which relies on rules of logic, solid argument and reasoning. Therefore, a court judgment is a manifestation of the truth, which the judge reached to after deep critical thinking and argumentative reasoning. Thus the language that the judge uses in issuing the decree should also carry within this argumentative logic.

Sans doute, les décrets des tribunaux se distinguent des discours, en général, tant au niveau linguistique qu’argumentatif. Quant à la langue de ces décrets, elle est restreinte par le contexte professionnel et par la nature des gens qui traitent avec ces discours. D’un autre côté, ces discours juridiques et judiciaires se caractérisent par une logique argumentative différente de celle des autres discours argumentatifs, tels que les publicités ou les discours de candidature ou encore les discours politiques, que ce soit au niveau des connecteurs qu’au niveau de stratégie. On dit que la langue juridique est une langue de convaincre, car elle s’adresse à la raison par le biais de la logique, tout en se basant sur une solide argumentation. Et puisque le jugement est la manifestation de la vérité que le juge voit, selon ses propres convictions, suite à une argumentation qu’il a développé avec soi-même, jusqu’à ce qu’il soit lui-même convaincu, le discours qu’il énoncerait devrait porter les traces d’une certaine logique argumentative.
