المستخلص: Childhood is the most sensitive stage in human life, as the base and the background that will lay the foundations of the rest of his life, which is the foundation of the child's mind and soul. Given the importance of this category to all societies, as the ammunition of the future and the men of tomorrow, all countries are keen to provide all forms of protection for them, including our Algerian legislator. However, despite this protection, today we are witnessing - and in our Algerian society in particular - the phenomenon of erosion of the foundations of the latter, and is increasing day by day spread and ugliness, the phenomenon of kidnapping, rape and killing of children. This phenomenon, which included the most heinous forms of crimes committed against the child, Through which the criminals exposed all the forms of protection prescribed in this regard. And the problem we will address in this intervention - and that despite the application of penalties for the perpetrators of these crimes - is the reason for the inability of the legal texts and penalties applied in the elimination of this phenomenon and the realization of the basic function of the penalty, which is the general deterrence? It is necessary, in light of this deficit, to seek other legal solutions and to apply the most repressive sanctions, namely the death penalty.

تعد الطفولة المرحلة الأكثر حساسية في حياة الإنسان، باعتبارها القاعدة والخلفية التي سترسم ركائز باقي مراحل حياته، وهي التي يتأسس منها فكر الطفل ووجدانه. ونظرا لما تمثله هذه الفئة من أهمية لكل المجتمعات، باعتبارها ذخيرة المستقبل ورجال الغد، فقد حرصت كل الدول على توفير كل أشكال الحماية لها، ومن بينها نجد مشرعنا الجزائري. إلا أنه ورغم هذه الحماية، فإننا اليوم نشهد -وفي مجتمعنا الجزائري على وجه الخصوص -ظاهرة تنخر أسس هذه الأخيرة، وتزداد يوما بعد يوم انتشارا وبشاعة، ألا وهي ظاهرة اختطاف واغتصاب وقتل الأطفال. هذه الظاهرة التي شملت أبشع صور الجرائم الممكن ارتكابها على الطفل، والتي من خلالها ضرب المجرمون عرض الحائط كل صور الحماية المقررة في هذا الشأن. والإشكال الذي سنتناوله في هذا المقال، وذلك بالرغم من تطبيق عقوبات على مرتكبي هذه الجرائم، ما مدى نجاعة السياسة الجنائية لمشرعنا في القضاء على ظاهرة اختطاف وقتل الأطفال؟ وما مدى ضرورة اللجوء إلا تطبيق أكثر العقوبات ردعا في مواجهة هذه الظاهرة ألا وهي عقوبة الإعدام؟
